Is this person you speak of suffering from depression or some mental illness? The only reason I ask is that they seem to have no fear nor conscience of the repercussions of their actions-I would be astounded if this person was not in the slightest bit concerned of the harsh penalties that will almost definately handed down to them.

The agony of BR does not appear to have touched them one iota which is what concerns me the most. Most people here that have gone through it are reeling from the experience for weeks and months following, and indeed before they have their day in court.

They will surely get the rocket for having a spend up at the taxman's expense. There is no way HMRC will tolerate that conduct particularly in these circumstances.

Tbh, I think a BRU/BRO would be a dam to quell the madness that is the whole situation. It is behaviour such as this intentional, calculated, oblivious or otherwise that they were invented for for anyway.

If you do not hear, then you must feel.

Yes, i think that theyre ill and need to get some help to sort this out.

I dont think that any bro's or prison sentance will change them to be honest.

Any normal person would be devastated to be told they could be sent to prison for 7 yrs, or maybe they think they wouldnt go to prison.

    What does anyone else think?

They did say they would goto jail rather than pay but did eventually admit they didn't really want to go and the thought scares them, after finally been told by CAB jail was a real possibility.

Whilst not diagnosed for depression i am damn sure they are affected by it, medical advice has always been on their bad back/hip and epilepsy. I was even thinking a few months ago maybe bi-polar, i spend most my time on DFW forums offering advice so know the ups and downs of bipolar causes alot of problems (even though i don't understand bi-polar). He certainly gets seen by doctors alot but not over mental health issues just physical ones (as far as i know).

Before I met them they had attempted suicide by OD (was very close call) at least once before, some years ago, but i do not know what it was over, i know from experience of losing my father thoughts of self harm do not go away easily. We do worry for them when they go into 'shutdown', its just they bring it on themselves almost without trying.

The HMRC is not affected, the tax debt per say is actually paid to moonbeaver not the tax man anyway. Tax is used to fund the OR i believe.

£4,000 is on the cusp of whether they would prosecute or not, in any event i think that a custodial sentence is unlikely. A BRO is far more exactly as well as a close examination of their finances to see what can be recovered.

Multiple bankruptcies are not automatically a BRO but would count toward it, but only bankruptcies in the last years and after April 2004 as the rules changed then

  • If they were bi-polar you would see evidence of where the money was spent.

I have my own ideas of where it has gone.

I've asked my mom and they do suffer from high and low mood swings, but i think that can be the nature of been in debt you try and struggle though each day.

I have also been told that they have brought items, irons, microwaves, kettles but they aren't around the house because the daughter has taken them to her own new flat. The new microwave was because this one had a grill even though the old one was okay, but daughter comes and takes old microwave anyway.

Further more, they are now under £4,000 owed, they have paid about £1500-2000 to the OR directly, no idea where that money came from i assume it was stashed away or something, ah the problems of been a friend of a friend, details can be a bit stechy.

Is the daughter the real problem here. If she is contstantly round the parents "needing this and that" and perhaps they havent the will to say NO. Perhaps time to have words with Daughter and explain the seriousness of the position her Parents are in.

They need to go to a solicitor and get legal advice ASAP, I'm amazed that the OR hasn't done anything about it already if they're aware of the 4k debt.
Are they discharged yet?? You're not allowed to get anything over £500 without disclosing it to the OR whilst undischarged?? Is the OR just letting it slide or what?

We have no access to the daughter, she spends time between the dad and mum so is not always there. For me to get to their house takes a good hour to hour and 1/2 with little traffic, its not like we can just nip round. She is either there or isn't, i personally in about 2 years seen her maybe 4-5 times?

We are so much of an outsider to what goes on although we are probably the most involved at the same time, they do not really let the family and friends know much about anything. The daughter is definitely a cause for concern, they gave away there first daughter at a young age and have regretted, they never want to speak to them again, so over compensation maybe happening on the 2nd daughter.

The debt is not credit, it is a debt to the OR. They notified the OR 2 weeks after receiving the medical severance package (well within the 4 week deadline on his paperwork), by of which point some of the £4000 had been spent. it took a while before they got final confirmation do not spend it by which point most of it was gone so i'm told. The OR has said they now want it all. I do not believe there is any wriggle room for them this time.
Which is why the original question was posted can people like this change, 3rd time BR and already in this state. No matter what we say, the change needs to come from them.
