As her elder child is coming up to university age she will also need to look at the qualifying residence period to be classed as a home student. Citizenship does not automatically qualify him for home student fees (approx. £3290 vs. approx. £13000 per year). I believe it is 2 years prior to the September he would start his course but she would need to check.

The children would be entitled to free secondary education up to the age of 19 years.

However the eldest would need to be resident in the UK for three years prior to the September 1 of the year s/he went to university. it might be necessary to take a year out to qualify.

Considering all the immigrants who have flooded in here and got housing, benefits, NHS etc etc. Surely to God your daughter should get the same.

Yep she's an immigrant and will be subject to the same rules as all immigrants. If there are reciprocal arrangements with Canada (hollow laugh) then fine - if not there will be a waiting period until she has established residency.

You shouldn't believe all you read in the Wail and similar comics.

I think she will need more than a deposit to get a private rental agreement. Most agents carry out credit checks and having no income she may require to pay 6 months in advance or a guarantor. Being on a low income, you may not be accepted.

Hi thought i would help you im a canadian living in the UK and we looked at both options..

Firstly, if any of those kids were born in canada they dont automatically get UK rights ( i have a son too!) and they will have to apply as immigrants

they have permission to come here but they will need to pass certain requirements personally i dont feel they will based on the no money unless you can support them and prove it.

I would tell her to contact social serv in canada to get some help if i knew what province she was in i can help you with accomadation money jobs etc. but each province varies.

PS she will have to get a notorized letter from her husband allowing her kids to travel to the UK..

OH and the uk has some barbaric law about spouses travelling seperate.. when i first came to the UK i was married and all though seperated unless my husband travelled with me i needed a divorce! So i couldn't come to the UK to work or anything until i got legally divorced. She needs to speak to a imigration lawyer again i know a few who offer free inital appointments.. if you let me knoe the province :)

Do all kids have UK passports?

I was in a similar position 11 years ago. Came home to the UK and all has worked out great. A lot of the things people are telling you on here are incorrect. I have dual citzenship as do my kids, we have had no problems with work, schooling, housing, government etc. I would encourage your daughter to come back home. If you would like to discus this further let me know your email and will talk to you somemore. Things will work out and don't stress yourself.

PVAD-- 11 years ago is a long time... no disrespect but a lot of rules have changed.

Firstly, You cant just take your kids away like that with out the other parents persmission. Have a look at the home office website it will tell you plus the embassy in canada for Ukers is pretty good for advice.
