Do i Pay Council Tax on unsold House

When i retired we purchased a new House in England, and put our unfurnished house in Scotland for sale on the Market in October 2009. So far we have not sold the house in Scotland. I pay full council tax on the house in England, But have just received a demand for the 20010-2011 Council tax for the house in Scotland. Are they correct in demanding we pay full council tax on both houses, even though one is not in use?

In England certainly, you can apply for a full exemption for a period of 6 months if the house is empty and unfurnished. After 6 months, it's usually a 10% discount that applies.Everything that is supposed to be in heaven is already here on earth.

If your other house is unfurnished and unoccupied you may be able to get a reduction on the council tax due, or in some areas no council tax is due, but it is often limited to 6 months.
If coucil tax is due then you may be able to get a 2nd home discount, generally around 10%.

Assuming the Class C exemption has not been used already then (irrespective of whether its scotland or england) a 6 month exmption applies if a property is unoccupied and substantially unfurnishedI no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -
thanks for the information, If the Class C exemption has been used and the house is still not furnished and up for sale. Does this mean i have to pay Council tax at the full rate until it is sold?0

You would possibly pay at 2nd home rate, which is usually a 10% discount.

I'm in the same situation, we got a six month exemption but we now are paying full council tax. It apparently doesn't qualify for 'second home' discount since it is unfurnished.
Someone suggested something to me which I have only just remembered, is there any way that I could claim single person discount? Nobody is living there, so if they insist on full council tax why can't I say that it's only "one person's house"?

AFAIAK you can't claim SPD as no one is living there.If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0

I suspect not, but it seems insane that I pay more council tax having no people living there than having one person there. I don't' even live in the same county ..0

Your right.
