Ebay debt collection policy

Can someone give me some advice.The first time I used Ebay to sell garden chairs I messed up the add and instead of 6 chairs it became 6 sets of chairs.I got such abuse from the people who then thought they all owned a set I emailed them all told them what had happened and gave the chairs to one of them free.I told Ebay with about 30 emails what had happened etc..and they still wanted payment of £35.They never called me and there is no contact number for them.To cut a very long story short they sent the debt to phillips who I paid in the end.I was worried about my credit rating.I have now got a letter from another company EOS.

So please can anyone advice me what to do now as the debt company is still hounding me after 6 months and Ebay have never tried to get this resolved.

I have to say this has stressed me out big time.

    Little confused, did you clear all the debt to Phillips? EOS are one of those companies that buy old debts from what I can tell, i.e. if you owe £300 they pester you for a bit, then eventually go ok we'll settle for £50 and consider it cleared.
    Did you know you can get Viagra software now??? Yeah, it turns your floppy drive into a hard drive :D

    I don't really understand how you ended up owing them any money.
    Unless you have a credit agreement (ie a loan, catalogue company, credit card, etc) owing someone money cannot affect your credit rating unless they take you to court and get judgement against you. You wouldn't have had a credit agreement with Ebay.

    I think you'll find thats incorrect you do not need to ba taken to court to have your credit effected. A bad debt can be logged against you without a CCJ. This includes missed payments. CC debts and iformation if a debt has been passed on

    if you have proof of payment then tell the new collection agency you've paid that you have proof of payment and if they still want to take you to court then so be it, show the proof of payment at court and they'll look a little silly.

    As I said only if you have a credit agreement. I cannot say that you owe me money and file it on your credit report, unless you have a credit agreement with me, I would have to go to court.
    The agreement with Ebay is not a credit agreement, no credit checks are made at the time of issuing the account, so they cannot file anything on your credit report.

    As with any of these things if you are concerned, don't listen to idiots on an internet forum, get some advice from a legitimate third party, a solicitor or Citizen's Advice.

    Sorry cyberbob but this is total bullsh1t and very misinformative to people reading this forum.

    as some one who now works in debt enforcement i know a little about who can record info on credit files and when.

    ebay supply a service to you on 28 day terms (or there abouts) but it is not a credit agreement of any kind and ebay can no more record information on your credit file than a builders merchant can if a builder (who is typically provided products on 28 day terms also) fails to pay.

    the only way any negative info can be recorded against you in these circumstances is, as has already been said, if ebay were to take you to court and obtain a judgement against you.

    also the link you provided only explains what a credit report is and how to obtain a copy, not sure how you thought that supported your misinformed view that any tom !!!!!! or harry can record negative info on your credit file.

    are ebay even registered with the I.C.O which they would have to be to share info with credit referance agencies?

    We seem to have lost the original problem... which is that even though the sales weren't exactly successful, and you didn't get paid, you still used ebay and ebay want their fees paid.

    It's not for ebay to sort out your fees - it's for you to pay them... or to get the fees cancelled by either mutually cancelling the transactions, or opening NPB disputes. Bit late for all that now I imagine.

    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j
