car accident who is at fault?

    well if your going straight on the right side of the road and someone backs out of there drive smashing into your car, dont you see that they are faulty even if your speeding as they should have checked properly before moving out....

    Make sure your insurance understands what happened properly and you may get letters from the solicitor of the third party to wear you down but let your insurance deal with them or get a solicitor/no win no fee company to help you if you want. If you dont have legal insurance.

    Dont worry too much, insurance claims are always a pain!

    If someone backs into the side of your car, then they are at fault. Simple as that. There is absolutely no way it can go any other way.

    That of course is a big if. As is usual on here we only get one side of events, and yes it all seems cut and dried as to who is at fault, but human nature being what it is, it is not uncommon for someone to ask on the forum how they can wriggle out of a situation they have created.

    And conversly, if the other driver staunchly denies he was reversing, no witnesses as I recall, then that is how it can go the other way, no point telling the op differently :eek:

    If the damage is to the side of the OP's car, and the rear of the other car, it's going to be difficult for the other driver to claim they weren't reversing.

    Thats the point, in the 1st post the op states there is no damage to the other car ;)

    And there are two totally contradicting versions, the op claims she was hardly moving, the other driver that she was driving too fast ????

    Which ever side you find yourself on, it's one thing being in the right but if someone disputes the story, without an independant witness things can go the other way.


    In actual fact his claim that she was driving fast so he didn't see her could swing things in her favour as that is not a suitable excuse if he agrees with the fact he was reversing, he may change his story yet again tho' as if you recall he 1st admitted fault :A
