Advice wanted re outside water pipe

I hope I am posting this in the right place.
My son is an invalid and has a ground floor adapted flat, he has been there for 61/2 years, the council have just given him permission to have a small conservatory on the back to house his wheelchair.

The people above him have installed a water pipe down the back wall from their kitchen to about 3' from the ground on my son's wall, took it round the corner into the ally with a tap fixed to the side of my son'e wall.

When the surveyors came to inspect where the conservatory will be built they said that the water pipe was put there without permission and must be removed and they wrote and told upstairs to remove it, so far they have not.

Now the builder is nearly ready to start work my son has asked the council what to do as the pipe is still there, they said they will leave it up to him,

My son is not bothered about a tap in the ally so he has asked them to alter the pipe much higher up and bring it down to the tap without it coming down the back of his wall, they still have not replied.

Now the builder say's he will just cut and cap it above the building line and then they will have no tap.

there is a lot more to this story, too much to put here, you here about school bullies, but not the sort my son has to put up with.

Any advice would be appreciated , Drind.

    No doubt they are probably stealing water or they have put a pipe to feed outside on property that is not theirs.

    It is very unlikley that the people in the flat above have/had any right to intsall that pipe in that position

    They've been given notice, so your son would be entitled to cut the pipe and blank it off

    Not really sure what advice you are after? The pipe/tap has been placed there unlawfully. The council (or their agent - surveyor) have requested its removal, as have you. They have failed to respond. The council have effectively given you permission to remove the pipe. The builder has said he will cut and cap the pipe. So just do as you have been advised and have the pipe cut and capped and the conservatory built.

    I would guess the builder, would use the tap to mix his concrete/motor, then cut it off. The cost of the blank is offset by the scrap pipe:D

    ie 3 ft of copper pipe and a bib tap.

    Id cut it off, and fit a push fit end stop. You could do that without making much mess, and without turning the water off.
    Post the tap and pipe through the letter box.

    ds who go out of thier way to make his life hell.
