Who's side is the law on?

Options
Hi,
I recently bought an Iphone through Amazon. However the seller stated he could save me £50 if I bypassed Amazon. I stupidly did this and paid by direct transfer. I am now out of pocket to the tune of £352 and after a month still have no phone! I have the persons account number and sort code, thats it! The police, Consumer Direct, Bank will not help me in any way. How can I obtain this persons name and address so that Consumer Direct will investigate? The only information I found was where his bank is. Any advice would be greatly appreciated.
Thanks.

Have you stated to the police that you want to report it as a crime?

The bank would generally not provide you with the person's details, since it would be a breach of data protection. They will only release the details to the police, in response to a direct request.

Firstly consumer direct and the bank will be of little use.
At this stage it is a civil matter of non delivery of product, potentially criminal depending on intent.

Small claims court is the way forward.

And if the only address you have for the seller is his bank then you can probably use that as a c/o address on the claim form - banks are legally required to forward letters they receive for their customers.
