    OP has been told many times on this thread not to pay any final payments until work is complete to his satisfaction and if there are any small remaining bits then agree a small retention so that the builder does come back and finish it.

    The VAT issue is more complicated and if the builder has genuinely got it wrong or has been found out and now trying to deal with it then the Op also has enough advice to deal with whether they wish to pay the VAT part and when they wish to pay it

    Without seeing the contracts, emails and invoices raised I think persoanlly its difficult to advise further. OP do you have an accountant? If so maybe run it all by them with the paperwork as it will be the only way you will get accurate advice to your circumstances rather than general advice (as good as some of it is) on here

    The OP has been told to get stuffed & he must pay the VAT by HMRC as he was quoted VAT in the first place.

    The builder has been rapped on the knuckles & warned of the penalties dished out by the courts for convicted VAT fraudsters (& he will be getting a visit & his full accounts will be scrutinised in detail, not that HMRC will find anything as he has had time to prepare) & the Treasuries coffers are up a few grand.
