Please Help! Employment questions.

My oh got promoted ruffly 10 months ago to his new position and did his trial and was told my his manager that he has got throw his probation and has the new job.

The company is now restructuring and his role is changing to something different and he has been lead to believe that he will roll from one position to the next.

Today after getting back to the office his manager told him he had an interview for the new position, only being given about 2 mins notice.
Interviewing him was his manager and 2 others from his office, In this interview he was told he has been on scumnes for the last 10 months ( my oh new nothing about this) since getting promoted and his manager is able to demote him on his whim because he owns him and that he will have a second interview tomorrow for the new structured position.

His manager also said that my oh does not have a contract but we ransacked the house and found one.

Please help, what can we do? Can they do this?

    Hi Beth, sorry I don't understand, what is 'scumnes' ?

    What does the contract say exactly?

    Sorry have no clue how to spell it. He was told he is still on trial.

    His contract says he has his job and nothing about him needing and interview if they restructure the job, The probationary period is 13 week and that can be extended for up to a further 13 week.

    A secondment basically means you are in a role other than the job you currently work in - for a specified amount of time in a different department, or within your original department - this can be within the country you currently work in, or outwith.

    ie: you are working as an accountant in accounts payable in London, your employer decides to offer you a role for 6 months helping out accounts receiveable in Amsterdam on secondment. You would carry out the work in Amsterdam for 6 months and then return to your role in London at the end of the secondment - or, if agreed beforehand with your employer and yourself - to another role elsewhere.

    If your other half was on secondment, then yes, he would return to his original role at the end of the secondment - unless agreed by both parties to move on to another role. So he hasn't been 'demoted' he was 'acting up' to a higher level on secondment, then returning to his role - which happens to be a lower level. Was he paid extra for working on secondment in a higher level?

    I know this as I have just completed a 3 month secondment myself.

    There will be differing details of course depending on contract, however, that is the gist of it.

    What does the contract say exactly about the secondment?

    He had an interview for his existing roll and now has a contract saying he has the roll. The first time my OH has heard about this was today in the interview for the restructured roll.

    How can he have a contract if he is not in the roll permanently?

    So, can you advise what the contract says that you found at home? (not the new contract) Does the old contract refer to a secondment at all? Did he receive any communication at all when he started the new role?

    If the company is restruturing they can and do require staff, even if in current role, to reapply for their role. However, there is usually forwarning of this - in fact I would be surprised if there was absolutely no notice of this at all.

    He can have a contract, however, if the company decides to restructure, unless there is a clause in the contract saying that he is unaffected by restructuring (unlikely) he may be required to reapply for his role.

    Did this happen to anyone else in the company?

    His contract does not mention anything about this.

    10 or so months ago the job was advertised in his office as someone had left, he had an interview for the position and got the job, he had his probation and passed that, his next manager up signed it off and he got the contract.

    This is not happening to anyone below him level he is the only one in his office at his level.. Other people have had interview for his position as there should be three in total, but they are applying for a promotion if that make sense. As hare as OH new this role would automatically be his, he got a letter saying.....

    they are changing his current roll to that of a **** due to working hours

    We confirm that should this plan be enacted, this role would come into effect for yourself after ***** when you will have the opportunity to apply for available roles within the office.
