    Income based ESA will not be paid when the partner works full time, they are treated as a couple for benefits purposes. Only NI credits would be paid.

    hi,healy thanks for the reply so in effect regardless of the fact that one person in the relationship is unfit for work the couple have to survive on the working partners wage and no form of benefits will be paid to the unfit for work person at all if it is income based ESA the person claiming benefits was /is on,TIA

    This is the case for all means tested benefits, not just ESA. The fact that only one household will need to be maintained should ensure that nobody is worst off.

    That is correct, they would not receive income based ESA as they are a couple living together and are expected to support each other.

    Contributions based benefits are no affected by co-habiting in any way, its income based benefits that are affected.
