removing defaults help

hi

just started to get things sorted with all my debts and corresponding with creditors. trying to get all creditors to agree to remove any defaults (2- egg and co-op) after paying full and finals (about 30-50%). debt with egg is being sorted with ARC who are saying they cannot get egg to agree to remove default as it is illegal to remove a default if the full balance has not been settled. when i tried to correct them and say they could be removed the guy said 'dont believe what you read on the forums etc'. i believe they are making this up and am willing to tough it out with them as they are saying they will now take this further. if anyone can confirm this situation please help

thanks all

Why on EARTH are you paying someone to do this for you? Let alone someone who clearly don't know what they are doing???

You can negotiate directly with whoever owns the debt and offer them full and finals and make it a condition that they remove the default - however many won't agree to do this and rightly so. You DID default the debt after all :)

Hang on is ARC a debt collector or a debt management company? (not that they know what they are on about anyway LOL - but if they own the debt then THEY can get default removed as they own the debt now... )

  • not paying anyone, arc is debt collection. i know i defaulted but cant blame me for still wanting it removed as business went under and circumstance dictated my current position, no wreckless spending etc and may want mortgage in near future. still on credit file as defaulted to egg so guessing egg still own debt, just arc acting on their behalf. anyone know if this is still possible to get removed?
  • anyone? thanks

You can ask - ask ARC if they own the debt or are acting on behalf of Egg... if they own the debt then send them a letter by recorded post offering them a full and final of £x on condition that they get the default removed. Say that you will pay as soon as they confirm in writing that this is the case. If they say no then you need to decide if you still want to negotiate the full and final or not...
