problem with creditexpert.co.uk

now, i dont know if this is the correct forum......

anyway

at the start of august 05 i joined the free trial of credit expert, and i used it for about a week. I then went to cancel it, so i emailed and called them to cancel my account, they confirmed they done this.

I then was billed £49.99 for subscription - of which, i said to them that i had cancled - and the instantly refunded this money.

Now, because of this, i was given an overdraft charge of £30.00 and then another one because it was unarranged and over 30 days of £28.00 - so a total of £58.

why did i have the 2nd charge? because i couldnt afford to pay the 1st charge that the bank wouldnt refund, so i had to leave it due to no money and the charge came off and another was applied.....

the 1st 2 charges (£30 (1st) and £28 (2nd)) both came from creditexprt.co.uk taking money from my account when i had canceled the account.

Now, i emailed them and explained to them all this - told them that the bank told me to get the money from them. They agreed on the phone with me all this, and asked me to fax in the papers to them.

I faxed in the original papers i got with the fine on them - the standered "you have went overdrawn" letters - both of them went and they never contacted me again. i emailed and they said that that wasnt enough info and asked me for statements. I got statements printed from the bank and faxed them - still, no email, untill i made contact and they say still not enough.

i sent a copy of my ORIGINAL statements of which cost me £10 to buy, and sent them, and they "lost" them

all i want is the £68 back from them for this.

its nearly a year now, and tbh its getting annoying. ive threatened them with legal action. what can i do to get my money back? - they have accepted they owe me this but are assisting that i have not sent enough proof.

    someone will be able to give you detailed advice on how to fill it in.

    however, if they have admitted this mistake (do you have proof?) it should be straightforward. to be honest, the mere threat of legal action will probably do the trick.

    ps. make sure you claim for the cost of your statements (£10) and cost of filing the case (about £50 as i recall).

    all i have is a few emails saying to send in my documents and that they cant look at the claim untill they have all the evedance :(

    You've had an awful lot of verbal contact with them. Do you have names, ext. numbers, dates & times of calls?

    Write them a letter quoting these details, clearly and chronologically set out what happened, followed by what you expect to happen next (let them have a schedule of charges you have incurred and ask them to reimburse some additional 'goodwill' for the time/trouble/distress this has caused you), and in what kind of reasonable timescale you expect it to happen.

    Tell them if they don't comply with your reasonable request, you will take them to the small claims court. You'll have to ask on the forum how to do this because I don't know!

    thanks for that, i do have names, and approx dates of the calls. i know its only for £68 but £68 is better in my pocket than it is theirs.

    i would personally expect it to be resolved within 14 working days. might just do what you said.

    I took a CreditExpert free trial earlier this year, at around the same time that there were numerous complaints on these boards regarding Experian failing to carry out the customer's instructions to cancel within the 30 day period.

    I managed to blag an additional 30 days (due to poor service from them - long story!), but when I finally did cancel, I adopted a 'belt & braces' approach in that I telephoned, e-mailed, and faxed them the request.

    I have to say though, that despite using the correct e-mail address, my e-mails just kept bouncing back as undeliverable (for a 2 week period!). For all I know, my fax may have got 'lost in the machine' too!, so I made 3 phone calls...the first to cancel, and the second and third to check my trial was cancelled. Obviously I noted the details of the calls just in case I later needed them.
