Do I have to accept Nationwide's offer to take charges off my still active credit card account or can i insist they send a cheque?

Is the offer 100% of the claim?
Do you realise that by them doing so it will reduce your overall debt to them but if you want a cheque the whole amount is payable still to them?

Yes its for the whole amount and really could do with the chq! And yes I do realise it would reduce the debt but really don't want to do the Nationwide any favours as they are terrible to deal with.

You're not doing them a favour, you're doing yourself one! If you have an active balance it is unlikely that they will send you a cheque anyway, the refund of the charges is just that, it's not a payment to you, it's covering a balance that has been created in part by said charges. If you can prove that you need the funds to pay priority debts they might send you a cheque for that amount. But it's a long shot. Good luck though!
