Xbox Gold Subscription Missold???

Hi All,
My wife is very big into Rock Band 2 on the Xbox 360 and there is a song she wanted that was available as a download on the xbox live site (she used to play it on the PS3 version).
When she went to download the song, the site stated that she required GOLD membership to download it. She hasn't had any gold membership for nearly 12 months as it was a waste of money for her but because she wanted this particular song, she paid the £4.99 subscription fee, however once she had the GOLD membership and tried to download the song again, the site stated that it was not available in the UK for download:mad:
Where do we stand about getting the subscription fee back as the only reason she subscribed was to get this particular song. She neither wants or needs the gold subscription.
We have spoken to Microsoft who state that the policy is not to refund subscription fees and have spoken to the bank who are saying that we cannot dispute the charge because she is receiving the service however we feel that we have been forced into subscribing to something we do not want. Surely Xbox should have told her first that it was not available in the UK before forcing her to buy the subscription?

Probably and yes the principle is there but it seems alot of effort/emails/phonecalls for a fiver....Always ask ACAS0 -

That's very odd. I've bought songs for rockband 2 and haven't ever had a gold membership.
Was she doing it through the rockband store in game or connected to her xbox live account through the dashboard?
If it was through the dashboard, is she using an english profile, or an american one? Because I have some spare accounts so i can get american and japanese demos early.
I don't know if she'll be able to do anything though unless you took screen shots of the prompts.
As a rule of thumb, you never need a gold account to BUY anything.

The way she found it was by going through rockband.com, searching for it there then when you click download it re-directs you to the xbox marketplace at this link:

When you click download to xbox360 you get a box pop up which states:

Sorry, this offer is only available to Xbox LIVE Gold members.
I have just tried it on my account as I only have silver membership....pointless trying it on the wife's account as she now has gold:mad:
When she tries to download it she gets the pop up box which states:
Sorry
This offer is not valid in your region, or it has expired.

Don't know if it makes any difference to what MS should be doing regarding this, but the site that you have linked to is the US site not the UK one. I guess this might mean that they don't need to tell you that the download is not available in the UK.0

Yup, it's because she went through rockband.com. The UK version of the rockband site is http://www.rockband.ea.com/uk/home.html.
She tried to download an american item, and while it is mind bogglingly stupid that games should have region locked content for DLC, that's the way it is and I don't think you'll have any comeback.
It's usually safer just to use the rockband store in the game because then you can't try to buy songs not available to you. That said, I thought Monsoon was free with the euro version of rockband. I've got both 1 and 2 and it came free with one of them.0
