Fixed Penaulty Notice (Essex Police) - Wrong Date

Hey all, I am looking for some advice please.

I took my 20 month old daughter to a toddler group this morning and parking on a road (half up / half down the pavement and road) which had a single yellow line.

The parking restriction says between 8.30 and 9.30am and 2.30 and 3.30pm as it's outside a school. I got there and parked up at 9.35.

Went into the playgroup and got back to my car at 11.15am.

When I got home I realised I had a parking ticket underneath my window wiper blade.

It's been issed by Essex Police as a Fixed Penalty notice (non endorsable offence) and is handwritten slip of paper with a printed number in the top right hand corner, and says in handwriting on 10/03/10 at 10.20am the reason for it being issued is "obstruction unecessary" (their spelling not mine). The issuing officer's name and rank is on here. Looks like it was a bobbie on the beat I reakon.

Well, today is the 11th March... - do I have any grounds for appeal? Yesterday I didn't even have this car as my husbands father had it all day.

I am aware that I should have not been parking half up half down the curb / pavement as pedestrians and prams, wheelchairs etc would not have been able to get past, so I truly do consider this a lesson learned by myself and will not park this way ever again.

My friend was also parked down this road but on a slopey bit and she didn't get issued with a ticket, so either parking on the slopey bit proved ok or perhaps she had more room the pavement side of her car perhaps?

Although I know I am in the wrong, if I can appeal and get out of paying £30 I would like to do so!!!

Thanks very much all.

Imho forget trying to appeal unless you have a cast iron case, with FPN's its easiest to take it on the chin. Magistrates court will usually favour the BIB and could cost you a lot more than the £30.00
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

I agree with Peter Piper on this one. However l would attempt to contact the officers duty sergeant or inspector and just advise them of the officers poor attention to detail. In fact you never no if you took it to the local station and SEE the inspector he/she may cancel it (although making clear your not disputing the issue of the ticket) now wouldn't that be good...although l doubt it.

Dare l also add....l wonder if it was a PCSO who wrote the ticket as l would have expected a police officer to be more careful with the attention to detail.

(I am now standing against the wall ready to be fired upon by any PSCO members)

The inorrect date does not disadvantage you in any way and so is immaterial, the court would not take cognisance of it..
    I would siggest paying this.
  • Thank you all for taking the time to reply to my question. I have now paid the fine.
