Car Tax Fine should I appeal it

Hello

Fab site and just wondering if anyone can help me PLEASE

I moved house on the 11th December it was all kinda sudden due to a diseaster of the flooding kind in my previous house

On the 21st December I fell on some Ice and broke my back (the coccyx bone)

My car tax was up for renewal on the 31st December but due to my broken back I couldnt even sit down on my bottom yet alone drive so I decide dto SORN it off the road.

I went to the post office with my log book and sorn form. I informed the POST OFFICE I had moved house and they said right Miss ******* please fill in this sorn declaration and your new address on your log Book page and then we will forward it onto the DVLA. I asked "oh okay do you post it" the clerk replied "Yes we can send it to them in our internal mail system but it takes 6-8 weeks for them to acknowledge and send out your new log book with new address.

I presumed and took it for granted the post office would sort it

Now nearly 3 months on I am much bette rand want to start doing local down the road trips in my car. Say to tesco 3 mins drive and the gym 5 mins drive journeys like that

So I have phoned the DVLA up and asked what I need to do to re-tax my car after it has been (what I thought of) as SORN

They have informed me THEY NEVER RECIEVED the documentation of the sorn notice or the log book change of address. HOWEVER MY DRIVING LICENSE came back at my new address?????:o

I have now been issued a fine of £40 for none licensing my car. BUT RECEIVED NO LETTER from them but has apparantly gone to my old address.

If the post office have cocked up why should I pay the fine I trusted them

Do I need to pay the fine or do I have the leg to stand on so to speak to appeal it. Whilst my car was what I thought of as SORN I still had it insured so I am not some scum bag that drives around not giving a toss I am a law abiding citizen.

Does anyone know what I can do??

And how did my new license happen to get changed with new address but my SORN declaration and log book never got received doesnt it all go to same office??????????????

Help please:A

They are separate depts. You don't even have to have a driving licence to be the the registered keeper of a vehicle. The DVLA don't talk to each other much.

Were you given a receipt for your reg. doc. when you handed it in at the post office. If so a copy of it and a letter of explanation (sent recorded delivery) should be enough to end the matter.

If not it is really up to DVLA to prove that you didn't send it as opposed to them proving they never received it. In that case a recorded delivery letter to them explaining what steps you took to notify them and a request of the evidence they have that proves you did not take those steps, should, hopefully also end the matter.

One other point. Do not mention any medical reasons whatsoever. They are irrelevant.
Also the DVLA could take this as a retrospective notification of a medical condition. They could revoke your driving licence until such time as they were satisfied that you were medically fit to resume driving, which would take months.

A slight but real possibility and it has happened. So don't tell them.
