Used car help.

Hi everyone, Hope you are well.

I am just after a little help on where i stand with my purchase. 2 months ago we bourght an 03 plate Audi A3 for around 6k for my wife from a used car dealership. We where told the car is was in very good condition full services and mot and had no problems. We where keen to purchase a warranty but where not sure due to budget at the time. The dealer informed us that the car came with a 3 month warranty and we could then upgrade the warranty after that time.

We drove the car home and immediately noticed a strange judder in the automatic gear box, having never driven an auto before we where not sure if this was normal. A day later my wife was admitted to Hospital and had to undergo an operation which kept her in for 2 weeks and unable to drive several weeks more therefor the car was not driven at all for this time.

Once my wife was again fit to drive and returned to work she started driving the car. Again there was a judder in the gearbox and the car appeared to be revving very high as if it was not changing gear. We showed the fault to my father who works in the motor industry and he confirmed there was a fault so we contacted the garage right away. After finding out they had closed the site we got the car from we where told to return it to there second site and deal with a different staff member there, which we did. We then did not hear a thing for a week and finally got a call back saying there is a gearbox fault, they cant tell us what it costs but our warranty only covers us for £250 and we will have to pay.

As far as i am concerned this car was sold with a fault that was clearly not described when purchased. A gear box fault on an auto car can be a very costly repair and we can not afford this nor do we believe we should pay for it.

What are our rights as far as the car being sold faulty. Will the 2 month gap make this more difficult. The car has only been filled up with fuel once so must have done about 30 mile and im sure they can see this on the mileage.

I exept that the warrenty is only £250 but surly this is not under that cover and falls under the car not being fit for purchase or as described?
