*UPDATED* Jeans, 2.5 months old, broken zipper

I purchased a pair of jeans from New Look on the 21st of December (I remember the date I was shopping for clothes for a holiday we took on the 24th of December).
Very happy with the jeans, threw the receipt out in Jan.
They have been worn 4 times and last weekend I went to put the jeans on and the zipper on the flies was broken.
I am hoping they will replace the jeans, as I really do love them. But without a receipt / proof of date of purchase am I scunnered?
I am hoping they will be able to tell when the jeans were in stock in their store... bit of a long shot I know.
Do I have any rights?
UPDATE: ok, so the manager checked them out, popped the code into the system and they came up for £15 (I bought them for £21). She said all she could do was call a few stores (only in their 'region') to see if anyone had them in stock as her store did not - for a replacement pair that is.
I asked about the option of repair. Manager advised as they came in at £15 she could 'resell' them to me at that price and deduct £5 for the zipper and it would be up to me to have them repaired. I agreed this is was a good option. so, she gave me £10 and I'm off now to find a friend or cheapest seamstress I know to see about fixing.
I'm very happy with this option. I get to keep the jeans I love and have £10 towards repair/replacemet zipper - all without a receipt. And yes, I was friendly, calm and polite. I didn't demand anything nor shout I'm staying put til you refund me. Just put my case forward and I'm happy with the outcome.
further update, have just found a seamstress on the high street 2 minutes walk from my house who will replace it for £7 :-) :-)

You can always ask them if they'll replace, just don't expect too much.
It should be fairly straightforward to fix though, if you know someone handy with a sewing kit they can probably put a new zip on for you.0 -
I would take them back, be nice to them and see what happens. I think they will probably replace/exchange.
If not walk away, find out your full rights and go back.
If you have no rights, go in buy the same pair take home, 1 week later take broken pair back to shop with new receipt and ask for a credit note/gift voucher!0 -

Don't be so stupid - it would be pretty easy to tell the difference between a week old pair of jeans and a pair that are four months old. It is also likely that the assistants would remember the OP from the first visit that you suggest (why would you suggest the OP going back to the shop without being aware of their rights?).
GoldenJill, an item should be durable, and it could be argued that a broken zip after such a short time means that the item is not. However, a zip could also be perfectly adequate and break through the jeans being too tight or being pulled too roughly - I am guessing these do not apply?
As you have identified, without proof of purchase you have few rights. How did you pay for the jeans? If by card, do you still have a statement?
If you cannot get a replacement pair, I would agree with Darksun. A zip should be pretty easy to repair, and it would mean that you got to keep the jeans that you like!Gone ... or have I?0 -
Hi, thanks for your replies. The jeans weren't pulled too tightly or roughly any more than wearning any other jeans. I wasn't doing any frantic lunges in them, pulling a steamengine nor cartwheels! ;-)
I paid in cash . . if they say we cannot do anything, I will argue that jeans are not meant to last less than 3 months, zip or otherwise - is there not some literature somewhere stating goods need to last a certain amount of time?
The good thing is, is that they do state the company's name on the jeans, on the inside of course!, so at least they'll be aware that I purchased them from their chain. They weren't on special, December was the first time I had seen them in this chain, so hopefully they'll be able to somehow trace that they had them instock around this time.

I'd take them back, and wouldn't leave the shop without a refund. If you start off very, very friendly and polite (which it sounds like you will!) they're much more likely to want to help you. I find it works if I sort of assume they're going to do the right thing, so rather than "can I have a replacement?" I'd say "Do you still have them in stock so I can have my replacement?", all of course in a very friendly voice.0

Go back to the store, try and go when its a bit quieter and the staff aren't so harassed, be nice and see what happens. Ask for a replacement pair which you're more likely to get than a refund (without the receipt). If they won't exchange them and you really like them then spend a few quid and get a replacement zip - but think more carefully about throwing your receipt out next time.0

I bought a padded jacket in the sale at New look last year in January. In March the zip went. I phoned head office ( the number is on the back of the receipt) and told them about it. They told me to take it back and tell the store that I had rang and they have said to refund my cash. They did this no problem but I was quite surprised as I had no proof that I had actually phoned them.
I had barely had the jacket off my back until that time. I thought that their customer service was great so give it a go and tell the truth.0 -
Oops Just read you post properly and realize that you don't have the receipt. It may still be worth ringing their head office - you'll be able to google the number, and ask for their advice if you are a bit worried about going to the shop.0
