A debt from years ago !!!! Please help !

Hello Everybody !

My name is Mario new here just wondered if anybody could help me at all please.

I have received a letter this morning from Gothia Ltd/Red Castle Recoveries stating that I owed £473.48 and was referred to them by CIT Group which I then rememebered that was another name for Dell's finance arm.

Basically I had a computer 5-6 years ago from Dell on finance, I did fall behind on payments a couple of years in, I did however manage to rectify this and I was ceratin it was all paid and finished (and so did my wife, who deals with all the money. So she wouldnt not pay up if we owed it).

I have not received any letters or paperwork from Dell finance since around 2006 with regard to the debt I owe. Which I think is very bad as they have let the debt increase and increase as the original computer was only £400.

I've looked around a bit and seen the templates for the CCA letter and think this will probably be the next step and see what happens from their really.

I've searched the DCA and have read a lot of comments from people that this company is enforcing debts they are not legally allowed too. Apparently buying unenforceable debts of companies and sending out scare letters on the chance people will pay up without question.

So basically if anybody has got any information on this company or advice on what to do next, I would be really really grateful !

    This is bizzare , i just done a search and come across this . I had a similar letter , saying i owe £977.40. I did take this out for a laptop , but there was problems with the laptop and it got returned.

    I don't know what to do and would also appreciate some advice. The laptop was probaly returned 18 months to 2 years ago. I don't know if i have any documentation now , i didn't think it was necessary to keep it as it all got returned.

    I also never recieved any futher corrispondance from Dell and was told everything was settled.

    Did you receive a letter from the same company, I don't know how you'd stand with returning the item looks like the credit agreement was never cancelled, what puzzles me is why have Dell not said anything ?

    I've had a nose round the internet and it seems the best way to get things started is to request the original CCA document from the DCA, a lot of forums I've read the DCA will fail to provide this and are therefore trying to obtain the money illegally.

    But again as you returned the item where do you go Dell ? Because I'll put good money they will say theyve past the case onto a DCA and its out of their hands.

    I'll have a bit more of a scout round the net, see if I cant find anything.

    Yep opened the letter today. Same company , it was purchased on the 09.05.08 , any corrispondance i no longer have, yes Dell should of said something, from memory it was purchased on a a buy now pay in 6 months interest free, if they were unable to take payments surely someonen should of been in touch with me.

    To the original OP Do you know the exact date that you signed the agreement if it was over 6 years ago it will become statutory bared and they wont be able to chase you though the courts.

    No I dont know the original date, I dont have any paperwork for it it was that long ago. It was five to six years ago estimate, I think the best thing for me to do is ask for the original CCA and see if they can supply one.
  • Funny I had a similar letter arrive this week for a laptop i brought. They stopped taking money from my account at the end of 2008 and i phone them as i had not received any correspondence. It was hard enough trying to get their phone number but when i did eventually get hold of them several weeks later they said I did not have an account with them and therefore owe them any money. I tried again another perhaps getting a different person who know what they were talking about and had the same reply. I had not received any letters from them saying I had not paid them etc. I was in a position to settle the account and perhaps save some money with an early settlement figure, but to them i did nto exist. So with other things going on at the time i then forgot about it until this letter arrive demanding full payment out of the blue.

    So I don't have a problem paying but what i am not sure of is could I have saved some money with paying early but they could not accept my request. I have dug around to find a phone number for CIT but all i get is a email address with no confirmation that they have received my email asking for full details of the agreement and terms, also to confirm how much i paid and etc. But obviously Red Castle Recoveries will be back on the phone chasing for payment or threatening court action, but I would like the details first before handing over any money I want to ensure I am not getting ripped off.

    Any one have any suggestions etc, these would be welcome!

    Where as now they have told me to pay immediately or face court action.

    This is incorrect, statute barred only starts ticking from the last contact between the two parties whether its a recorded phone call or a letter etc

  • I've sent them a CCA request letter today so I've got to wait for them to reply within fourteen days.
