thats the compensation clawback scheme and it cost me more money than you recieved in damages, every penny you recieve in certain benefits can be recovered from you compensation and you solicitor should have made sure that it was taken into account before you accepted damages to make sure it didnt come from your lump sum.
it seems to me that you have had very poor advice.
Not quite correct Sunnyone. Generally offers to settle are made in separate parts and more than likely, the OP's offer would have been £16k general damages plus repayment of any CRU benefits payable. Global offers are sometimes made but more often than not any solicitor with nouse rejects these due to the ongoing nature of the benefits until the compensation is actually received, thereby reducing any general damages compensation on a weekly basis until settlement is achieved/compensaion paid.0 -

You had a large payout of compensation money that you did not inform the DWP of. They found out and want to question you about it. You should of told them straight away. It doesnt matter that it was compensation and not earnings. The DWP will probably ask you to pay back all of the benefits that you claimed whilst this money was in your bank. It makes no difference if its compensation or savings. They will want to know why you havent declared it. Sorry to sound so blunt.it doesnt matter jacks**t to them, they will want you to tell them why you havent declared it, and they dont look favourably on that

Well it's good news! I have finally had my IS reinstated, as I was able to prove with receipts what it had been spent on (compo £) and that it was vital spending! My IS claim was backdated, but for only three months though....Also I was pleasantly suprised to learn that I can have/qualify for higher rate on both counts of DLA., after a check up.
I didn't expect that at all, and it just goes to show that if you are persistent, and manage to get good advice, on this occasion an ex CAB employee/volunteer (welfare rights) who was recommended to me, then it pays off. Uncle Bob will be pleased that the money he had to lend me will now all be coming back to him,
So what I would say to anyone else reading this in a similar situation is keep any relevant receipts for several years, and when appealing/being interviewed have a decent representative with you.:beer:0 -

With respect to my fellow MSE's, this isn't the first place I'd be rushing to with my good news. Perhaps she had other things to do since getting the news and just got around to telling us.
