Paypal And Chargeback

Hi first post, looking for advice
Last December i sold an item on eBay, buyer bought it with buy it now, paid instantly and sent an email asking if i could hurry delivery as it was for a xmas present, no problem i thought although he was anew user with only 4+ feedback,
Then in February i received an email from paypal saying that the buyer did not authorise the payment and that his credit card company requested a chargeback, and could i provide info on the transaction.
I sent as much info as i could although i did not have a tracking number from the courier any more, well it was 2 months ago.
I then later found out that the other sellers who left feedback also where requested chargeback's, well only the ones who sold expensive items like me to this buyer, So i contacted paypal and told them of this, one seller even provided me with all the user names the buyer used, but same postal address, Paypal eventually responded with an email telling me that the card company have decided in favour with the buyer, and now i owe paypal £210
I sent loads of emails to paypal reminding them that this is a scam, and why should i pay.
They replied saying that i did not provide a tracking number and did not have seller protection set up, ha-ha, why do i have to set up protection when my buyers have automatic protection and i have to pay the fees,
So the latest is i am now been referred to a collections agency, and have seven days to pay, even though i didn't receive the letter till Saturday and it was sent on Thursday.
I have a 100% credit rating as i recently found out when i went to purchase a new car, it would really anger me if i was to lose this because of a scammer on eBay.
Does anyone have any advice on what i can do, what would happen if i didn't pay the collectors

sorry to go on just a bit

best thing to do would be go to https://www.paypalsucks.com and https://www.paypalwarning.com - they have forums dedicated to the paypal sham company.

all i could advise would be to call paypal and just tell them that you are not paying due to the fact you sent it, and they received it. this is now july and they got it last year. but go to the 2 sites above and you will get the asnwer you need ;)

Sorry for your loss. Dont think there is anything you can do as this is the way Paypal is designed. They wont swallow the loss if a credit card chargeback is done - they will pass it onto the customer even if they rip you off with the fees.

Same thing happened to me when I sold a rather expensive phone on ebay - about 2 years ago.

Since then I have not used ebay for anything valued over £5. And I will not be using it in the future for selling stuff on (unless its worthless).

I chose to pay paypal because I couldnt handle the hassle at that particular point.

    can you post his ID?

Best thing to do is to contact every seller and get them to send in their letter of complaint together with your, keep bombarding them until they admit that the buyer is a scammer and all paypal did is help contribute towards the scam.

Another way is to get all the sellers together and "claim" your money back directly from the guy. You have a higher chance of success doing this then paypal giving you back your money. one more thing is to fire a letter off to watchdog and hope they can look into it.

    good luck

The only thing you can do is pay PayPal the £210.00 that you apparently owe. If you don't pay and PayPal pass it on to debt collectors then it is very likely that it will affect your credit rating.

I had a chargeback at the begining of January this year. I did have all the tracking info and supplied it. I repeatedly asked them by email when was happening and whether it was a customer organised chargeback or whether it was fraudulent transaction chargeback, saying that it was imperative that they reply so that I knew whether to get the police involved for fraud.

They didn't reply to any of them, after a month I phoned them up to ask whether they were going to inform of what was happening, to which the woman, oh, it was a fraudulent CC transaction and they have found in favour of the credit card company. I did polite ask why the hell they wanted confirmation of delivery because it made absolutely no difference, to which she said, od it's just standard procedure.

I sent them an email to tell them I held them responsible for the debt for failing to inform me of the situation in a timely manner that would have allowed the police/myself to investigate/recover the goods and that if they persued the debt I would sue them in the small claims court for the same debt. Well that was back in January and they stopped sending me their bog standard emails about it, sometime back in April. They only pain was having to open up another account as the old one is still in a negative balance.

Report the matter to the police with the evidence that you have so far and obtain a crime number. You have posted goods to an address where someone has used a stolen credit card (or more likely lied to their bank that someone has used their card without authority). The police will probably try to tell you it is a civil matter. It's not, its a crime.

Send a recorded delivery letter (not emails) to Paypal asking for a full copy of the investigation that they have carried out so you can hand it on to the police, quoting the crime number. Advise them that until you receive this you will not pay the money they demand, and if you receive any further demands from them prior to the evidence being provided you will report them to the police for harassment.

Do not use your Paypal account or put any money into it.

You will not hear from Paypal again.

Hi well as i said above, i have received a demand from a collections agency, and the letter was addressed to my mum and dads house, i obviuosly didnt update my paypal account, so to save any hassle with crediters maybe getting my mum and dad blacklisted i just paid it today, As for not using my paypal account, it was frozen months ago anyway, think they took the hint when i didnt update my credit card when it expired, plus all the emails i sent telling them that i wasnt going to pay, thats why they passed it on to debt collectors,
Thanks for all you advice, wish i asked on here months ago, but think i may have left it too late, maybe theres a way i can scam paypal back;)
    cheers

    Correct again.

And correct again. Don't give in to these bully boys, they are in the wrong and they know it. As I and altarf have said, if you stand up to them they will back off, they will not get involved with the police or go to court.

    Hi Road hog,
well where do i go from here, I had to pay the debt collectors, didnt want to lose my credit rating or blacklisting me or my family,
In an earlier email i got from paypal they said they would not deal directly with me, ie they wont send me any info, but would work with the police,
Although this is fraud, i dont think i have a leg to stand on, i sent item to a un confirmed address and i lost the tracking number, and according to there rules thats the 2 most important thing to be eligible for seller protection
