Got the wrong item from an Amazon Seller

I looked for Letts Maths 2008/2009 for my son on Amazon, found it listed, purchased the item and ordered an extra one for my sister too
I got 2 copies of the 2004/2005 editions
I wrote to the seller and these are the responses
I was unable to provide a link to the item as purchased but having checked and double checked, there is nothing on there stating it is anything but the 2008/2009 version - the only 'description' on the page, is a product description and even the release date is stated as 2008!!!

I did email you to make sure you read my decription on day you bought them, i did said in my decription it for 2004 2005 NOT 2008 TO 2009, and did tell you to email me back if you didn't read the decription. But had no reply so thought you have read my decription.
You are welcome to send them back but then will need be sealed still and won't able to refund you postage cost
This is from the reference number confirmation of the purchase in AmazonMost buyer would of read the email if them recieve one from a seller make sure theres no promblems, i know i would i do...... I can understand what you saying and feel for you but if you look on order page you will find out I DID PUT 2005 TO 2006 i know i did as just check my self to make sure i did all i dream it. It there right at bottom where says comments. You should seen that before you bought the item

Well even they seem to be confused what they sent they refer to it as 04-05 and 05-06, not to mention the title.
Somethings uo here and you need to warn both amazon ad trading standards because this isnt good or legal practice. I assume from what i read of his email which is quite hard to understand that you bought 08/09 and only after thet did he email an invoice/confirmation stating 04-05?. If this is the case then you can claim a full refund for postage both ways and the item under the sale of goods act 1979 as the goods are "not a described".
As a side, you also have a basic right to return any item for any reason when bought over the net, phone or catalogue up to 7 working days begining from the day after you receive the goods. This is under the distance selling regulations 2000. If you are still within this limit you could also mention this to give him 2 laws allowing you return. The DSR allows a full refund of the item and postage, however return postage depends on the T&C's of the busiess. Dont worry about this though as SOGA means you should get a refund for this too as the goods are not as described.Back by no demand whatsoever.0 -
This seems to be common on Amazon - I've been caught out a couple of times myself. I think Amazon will only allow Marketplace sellers to sell items which are in their database. That means if the items is NOT in the database then sellers can't list it. When this happens sellers often list it under a similar (but not identical) item and rely on the description to indicate any difference.
I would complain to Amazon. You should get all your money back as the seller is clearly at fault here.0 -

Not quite true if they are a good seller they can add items to the database but you need IBAN and/or ASIN numbers etc.
As for your second point agree entirely send the items back and ask for a full refund by return. (Better send it tracked) If they don't just contact Amazon they will sort it out (might take a while as they ask the seller nicely at first)0
