Sorry but need to complain

hi all
having used quidco to do most things and it helping me to work at becoming debt free just like many on here do just want to rant about M&S and quidco to all you who also use quidco to help make ends meet on this forum
ive talked about the problem on the quidco thread on the referrals board so not really looking for advice more just awarning to everyone here

to cut a long story short i placed an order with M&S in dec via quidco the cashback was then declined i made an enquiry with quidco and it was again declined
so i decide to write email M&S to let them know how disgusted i was and that i would no longer be a customer then came the following reply

Dear
Thank you for your email to Sir Stuart about the order you placed in December. I work for Sir Stuart as a member of his personal team and I’m therefore replying on his behalf.
I’m sorry you’ve been left feeling disappointed with M&S as you haven’t received cashback from Quidco following the order you placed in December.
Quidco is a third party website. We have an agreement to pay commission to Quidco in certain defined circumstances as they introduce customers to M&S. Quidco have a separate relationship with you as their member to pass on this commission to you. Below is an extract from Quidco’s website which lists typical reasons why commission may not have been paid to Quidco:
It is disappointing when your cashback is declined and there are various reasons why this might happen. These are listed below:
The purchase was returned, cancelled or the order amended
The purchase was not completed wholly online
Another referrer has been awarded the cashback commission (e.g. a price comparison site)
You did not comply with the terms and conditions of Quidco or the retailer.
A voucher code or gift code not authorised by Quidco was used
The retailer has ceased trading or has gone into administration
If you feel that your transaction does not fit within the above reasons please raise a declined earnings enquiry by following these steps:
On the Quidco Homepage, click on Support
Click on Earnings Enquiries
Select the relevant earnings enquiry
As stated above any query relating to cashback must be pursued through Quidco as it is their agreement with you to pay cashback. If you have done this and Quidco have investigated and concluded that cashback will not be paid; this is because your order does not fulfil the conditions agreed with Quidco. Whilst I realise this is disappointing, we have no agreement to pay you cashback. We have a direct relationship with Quidco only and they in turn have a relationship with you.
I do note that the extract above details one of the reasons commission won’t be paid and Quidco in turn therefore will not pay you cashback is when an order has been amended or cancelled. From looking at the details of your order I can see that an amendment was made after your order was placed and some of the items in your order were cancelled as they were out of stock. Having said this, I must reiterate that your agreement is with Quidco, a third party website and any query needs to be directed to them.
I hope my email has clarified our position. I am sorry you remain disappointed and I do hope Quidco can resolve this for you. I’m sorry I can’t be of more help on this occasion.

I have highlighted the part that states why they did not pay the cash back its because the order was amended by THEM due to some out of stock items so therefore they pay no cashback the orignal order was for just over £150 and after they had cancel a couple of items i paid just over £133 but they feel they dont have to pay cashback because the items were out of stock i think its disgusting and just wanted everyone to beware
also before anyone say cashbacks not garanteed i know that but because they couldnt fill my total order i then dont qualify for cashback seems wrong

    I had the same happen with Boots when a load of sale stuff I ordered turned out to be out of stock.
    Unless I say otherwise 'you' means the general you not you specifically.

    I hadthe same with Ethical Superstore. Actually, the one thing I really wanted was out of stock. I could have lived without the others longer, was just taking advantage of the free delivery if I got it all at the one time. I don't know about Boots and M&S, but Ethical Superstore don't give you the option to review your entire order if some things are out of stock. I think this should be allowed as a matter of course. i would have cancelled my entire order until the item was back in stock (which I guess the companies figure customers will do hence why they amend it and processo n regardless).
