    Makes a complete mockery of Listed Buildings but wish you luck anyway.....I'd still want it in writing though...lol

    Cant you apply for retrospective planning permission then? I personally wouldn't touch a property without the proper planning and building consents, with or without indemnity insurance.

    You may find you are limiting the number of people who will be willing to purchase your property, and if you're not clear about it upfront then you might let someone get part way through the purchase (having already incurred fees), and their solicitor uncovers it. It will get flagged to the buyer if the solicitor does what they are meant to.

    To be honest I would just put ot on the market and see what transpires, if someone is really that worried about it then you will have to compromise on price, I'd flag it up at an early stage and point out that everyone else in the row is the same - your buyer is less likely to have lost touch with reality at that stage of proceedings!

    Then you are ineligible for indemnity insurance, I would think. I do not know if this would render a buyer ineligible too, but if they were, you would need some chinese walls in place to avoid tainting them with your knowledge ...

    a bit over cautioous as majority of people do. consents do not mean the works were carried out to a proper standard, only a survey can guarantee that. they help to say they had approval to be carried out provided they meet a certian standard of actual build, as the consents come first.

    provided the enforcement period has lapsed, then nearly all lawyers will advise to proceed, provided the surveyor says the build appears sound, and the buyer intends no futher works (as the council could enforce compliant despite being out of time to enforce as a ransom for consenting to the new works. That has happened.

    your lawyer always advises...but many fail to when you employ the national factory outfits...but then people like cheap legals!!
