I'm not sure how they can dispute it. They hit you not the other way round, unless your car can magically drive sideways, clearly they weren't looking in the direction they were reversing.

Are they disputing the accident ever happened? Or are they saying it was you who hit them?

I dont know actually - I was just told that they are disputing it. Strange as originally all was ok as the car has been fixed - its only now we find out its a dispute!

Did you fix it yourself or has it gone through their insurance? Their insurance obviously found you in favour so agreed to the repair. The other party doesnt have a hope if they have now changed their plee

just spoke to the insurance company - his insurance disputed it initially 5 days later as he hadnt reported it to them but now they are disputing it again, my insurance are trying to find out why...a joke if you ask me!!

the funny thing at the time was I was in a real panic as he said he had no id on him, said he was insured by Avis (the car rental people) and was about 50 miles from home...it was all very fishy to me.

No, often your own insurance will arrange the repair and then try to reclaim it from the other party's insurance. This is where the disputes arise. Normally your insurer should fight quite hard for this.

Always take photos of the accident and the scene before moving the vehicles, even if on your mobile. Some people keep a cheap disposable camera especially.

They backed into the side of your car, i assume)
are they trying to say your car went sideways into them.

How about ?? the other car was reversing and they saw the OP driving towards them very quickly and they could see he was on his mobile phone totally distracted, so they stopped, put on the handbrake and sounded their horn, that is when the OP swerved and braked, hitting the rear bumper of their car ? happens all the time :) and may end with a 50/50 deal.

But still 'other car' should make sure that the road is Clear enough to Initiate and Complete the manuovre without being any danger to other road users......
    just my humble opinion

When "the other car" started to reverse, the road was totally clear? then there was a squeal of tyres and the OP came flying round the corner and crashed into them ;)

Always two sides to a story where the insurers are involved and any doubt, regardless of truth will end in a 50/50 knock for knock and unfortunately the OP has no proof this didn't happen, sounds totally contrary to the Op's version, but plausible.

I have dealt with collisions for over twenty years and nothing surprises me as to different peoples versions of events, how people saw the same collision? and also how devious people can be in making up varying accounts in order to get out of accepting blame.
