Property possession: N5 or N5B?

I need to regain possession of my property which is rented out. The tenancy started in 2005 and has been renewed since. The tenancy finished in August 2009 and I did not renew the agreement as I wanted the tenants to move. I gave them a section 21 notice and after expiry they still did not move out, however they still continued to pay rent. In December 2009 I issued another section 21 notice which expired in end of Feb 2010.

I would now like to start court proceedings but unsure which form to use. I only want possession of the property and not claiming rent arrears. Please advise?

    IF you only want possession then N5B as this is the form for accelerated possession proceedings. You cant include any claim for rent arrears in this though. The matter is usually dealt with on the paper app in judges chambers without the need for a hearing providing your s21 is correct of course.
