    Possibly - hope so, as I really, really hate these schemes where people buy their parent's council homes solely to make a profit.

    Who knows whether they would just class it as a standard eviction by a private landlord or go back further to investigate the loss of her original secure tenancy? How far back do they go to determine whether the actions of the tenant has contributed to her potential homelessness?

    In anycase, they might just stick the MIL in a b&b or hostel or introduce her to a new private landlord if they find in her favour .....because of the shortage of social housing in the area caused through the Right to Buy.

    yeah, my husband lived in the property at the time of purchase, he moved in with me about a year and a half ago.

    You can sell the house at anytime, but you wont because you would have to pay some of the discount back to the council, wont, not cant.

    You might be able to request a community care assesment for MIL. This is usually done by Social Services and as I recall, is a 'request only' facility. That means you have to ask for an assesment if MIL is struggling.
    However, this does put you into the realm of SS, and therefore the mire that is Communtiy Care, (or protection?)
    I guess it depends which is your need for the post; Housing Benefit for a home she doesnt pay rent for OR placing MIL in a safe enviroment?

    Oh and BTW: even if she doesnt pay rent, she prob does have a default tenancy: therefore she has tenants rights. If the home she lives in whicht your husband owns is not up to community care minimum standards, he could be made/ advised (depends which way you look at it) to get the accom up to scratch.

    Not suggesting this is the case of course, but you'd be amazed at what is considered substandard for those 'at risk'.

    But would they be classed as landlord and tenant? Certainly doesn't appear to be the case from the OP.
