Reclaiming from Shop Direct

Hi, not been on for a while. Been waiting for a response from SHop Direct. I sent them the two template letters on MSE....I've had charges of almost £300 with them in last 18 months. I managed to clear the account to zero balance just before Christmas but again because I was late doing this, they added £12 charge on a zero balance account. I wrote to them again refusing to pay it, with copies of all the other letters - they then added another £12 charge on their £12 charge of the month before. I then used the letter re financial harship and amended it accordingly. They wrote back saying as a gesture of good will they would clear the last £24 charges but wouldnt be paying any of the £300 and they would close the account as i had asked them. They enclosed the FO leaflet.

Should I try and pursue it now with the Ombudsman? It's a lot of money and I am not working at the moment and definately fall into the catagory of hardship. Has anyone had any success doing this or with Shop Direct?

    Why did you claim financial hardship on a store card claim? has MSE mentioned claiming financial hardship on store cards now??(That is wrong btw).

    Okay so that was wrong, what is the next move for the OP? I would also like to know because shop direct are relentless. :mad:

    Natwestmember.....Can only apologise....in my ignorance, I must have misread the templates or guide and thought I could use this for store cards also.... I have a Lloyds charges claim running too.

    Shop Direct sent me another letter today saying that I never mentioned Hardship in previous letters, made no effort to offer any payments to them, and therefore would not be considering my case any further.

    I guess thats it then and due to my own stupidity....gave them a letter that they could come back to me saying as much.

    Ho hum...:(

    Your request is under UTCCR 1999 and therefore if they are saying "tough" to you then you have a choice, file a claim at court or go to the FOS for them to adjudicate. I suspect that it may be an issue of going to the FOS if the charges are prior to April 2007 since they were not regulated by the FSA prior to that date.
    Write one last letter stating that you are allowing them one last chance to return the charges back to you or you will sue them in court and will make the judge fully aware of this offer and will apply for a wasted costs order should they settle once you have filed your claim.
    Don't be frowning just get on with getting your money back, ok ?
