Delayed flights. Compensation or C/Card clawback...

In January our flight out to Tobago was delayed.

It was snowing that morning (13th) and the runway was covered in snow. By the time the snow was cleared, the flight crew were past there hours. We were not offered any drinks, meals or offer of accommodation. After 6 hours we were told it was been delayed for 24 hours. Monarch blamed tour operators and vice a versa for the no offers of anything. Fair enough it was snowing and no one can help that!

We were just told be back the next morning other wise you'll lose your seat. Planes still took off that day. We had to find our own B&B and paid for the taxi both ways. Total delayed time was almost 26 hours.

Eventually got there and had a great time :D

The flight back coming home? Plane left Gatwick on time but arrived in Tobago a day later. It had to land in Manchester because of technical issues. Once again we had to pay for taxis and accommodation. Delayed for 23 hrs 43 minutes.

By this time we just wanted to see our own bed.

We're out of pocket about £240. Insurance company don't want to know. Insured through HSBC's wonderful top of the range package!

Anyone had this before and managed to actually claim the expenses from either Golden Caribbean or there credit card?

    Why on earth not? Just about every insurance policy pays out a flat rate sum per 12 or 24 hours delayed - all you need is proof of the delay. (Some policies it is outward only)

    Or have you confused them by trying to claim your out of pocket expenses rather than the flat rate?

    Oh. Insurance will only pay £25 per person for each complete 12 hour delay.

    Quick update...

    I posted a letter to Monarch about the 600 euro as above. Gave them 14 days to reply. Maybe trying to drag out and hope we get bored?
    Not heard anything so not to sure how to go forward with this.

    Been ignored by Monarch since then.
    ATUC have been involved but have stated Monarch will reply to us within 28 days.
    Not heard anything at all and nit sure where to go now?

  • I'm about to launch a claim against Thomas Cook for a delay into Gatwick on Wednesday morning. I've seen a suggestion on another site (air-passengers-rights) that no papers have been filed to date with the ECJ. If this is the case, it could be that the stay has lapsed. I did ask the poster what happened in her case, which was due in the County Court on 4 Jan, but have had no reply - it may be that she has settled out of court with a confidentiality agreement so can't comment further. Does anyone else know whether the stay is still live? I intend to call the High Court on Monday to ask what has happened with the stay and will post any update that I get
  • Cityboy, thanks for the reply, but I think I will call the Court in any case, just to satisfy my own curiosity. You see, I am a lawyer and I know that a stay can be granted on terms, ie subject to papers being filed within a certain time. Now apparently according to the other post I was talking about, checks with both the High Court and the ECJ on 8 December produced the result that no papers had been filed to pursue Tui etc's challenge. If this is the case, it could be that the stay has lapsed and this is not something that would necessarily come into the public domain - it is certainly something that the airlines would not want us to know about! Anyway, I think it is worth checking out and I will post anything I find out. Thanks again.
  • Thanks Cityboy, I saw the stuff on this on Flightmole earlier today, including your helpful post there. If the rumours are true and the airlines don't think they will win, no doubt they will drag their feet as much as possible in getting this heard. i think I am going to write to Thomas Cook to put them on notice that I intend to file a claim depending on the outcome.
