awarded in our favour - How can we get our money?

My mother along with her colleague has recently been awarded £7000 (her friend £3000) at an employment tribuneral. they were dismissed without warninig and not paid redundancy money owed to them. this has taken over 12 months to conclude and has been an overwhelming and stressful experience for all involved.

Although fairly complex here is the setup of the businessman that we have won the order on. He is a declared bankrupt and has his three businesses in his wifes name. Although she is involved in the business he very much runs the businesses - he even turned up to respond to the tribuneral instead of her (much to the annoyance of the judge - as he had to adjourn) in effect he owns it in all but name.

Now the judgement has been made and logged as a CCJ with the courts and there has been no reply from them in terms of payment. they have applied for an appeal of the decision but seems that they very weak legal grounds so we just have to hope and wait. we cannot enforce the judgement until we hear the outcome of the appeal sifting and then if it gets through; the appeal itself.

We are concerned that this slippery customer is using this process as a time buying excercise to transfer assets into his 20 year old daughters name. obviously he is a declared bankrupt and this substantial CCJ is now in his wifes name - they only have their daughter left (I think) in the family.

I suppose my questions are is it possible for him to do this? Is it an easy process to transferr assets?

If this did happen what enforcement methods would be left available to us?

i know that this guy left a lot of people out of pocket when he delcared bankrupt and within months his wife had opened the new business - this guy does not take responsibilities serious and I want to be ready to put on the pressure and not let him get away with doing this to someone else in the future.

this is a very condensed version of events so please ask any questions you may feel necessary to clarify the position.

    could anyone point me in the direction i might be able to find advice on this issue?

    If you had a solicitor represent your wife, can you not ask them? Alternatively, can you not contact the employment tribunal office and ask - they may be able to advise your next step.

    Edit: See the court leaflet "I Have a Judgment but the Defendant hasn't Paid" which gives information on the various pays to enforce judgment including bankruptcy. Obviously if assets have been hidden you may well simply be throwing away money in court fees for no return.

    In what name was the judgement awarded? It ought to have been the name of the employer, but can you confirm please?
