recorded I did ask them how they wanted sending and they said signed for

yes but the method of sending is for your benefit, they just want their item back
you need to insure it gets there and you have proof it got there
instead of 75p for RD you could have paid under £5 and it would have been fully tracked and insured

its is £39 (100x the value of a 1st class stamp) however that is way short of the price for you to replace their blackberry
it doesnt matter how they asked for it to be sent
as it stands you have no phone and no proof they got it back

The problem here is that many people do not understand the difference between "recorded" and "special delivery" (which includes the concept that used to be know as registered).

Both are "signed for" in that they require a signature on delivery but the compensation levels and the amount of tracking are vastly different.

Providing the firm don't try and change their tune and insist they meant special delivery then you can argue that you have done what was required. At least you have proof that you posted an item to them (although as I said earlier none of these postal services prove what you sent).

This was the reason I asked earlier if the firm have any insurance that covers property in the possession of staff?

Signed for does not mean it's actually going to be signed for....
I recently got registered post delivered by the postman together with the other mail, through the letterbox....

You can get a copy of the signature the RM claim to have obtained on delivery. If you can show this is forged a criminal offence has been committed and the postman will lose his job - at least.

Well if you don't understand that it is an offence to forge a signature then it is probably a good thing you are an "ex postie".

Here is an example of a postman being sacked for this.....

    http://www.dailymail.co.uk/news/article-1246608/Postman-signed-parcel-behalf-frail-customer-lost-job-Royal-Mail-took-disciplinary-action.html

OK, in this case he may have had the best of intentions but under some circumstances the implications can be very serious. For example somebody may be unable to respond in time to legal documents. Is the sender is given a forged signature claiming they were delivered the sender can be forgiven for treating them as ignored.

When I used to work from home this happened to me. Two recorded delivery letters were put through my letter box. I had a polite but firm word with the postman concerned. He claimed he was trying to be helpful - and maybe he was - but he may also have just been saving himself some effort. The letters were from clients and, had I been away, they may have been unanswered for several weeks. The client would have been told they were delivered and signed for.
