    It sounds a nightmare Tim.

Did you keep records of what you sent etc? Sent by recorded delivery and note down the phone call times and who you spoke to.

If they treated me like that I would turn the tables and take them to court without hesitation.

As I say I don't know much about them. Can you not visit them or have a meeting with them? Is there no way you can come to a private arrangement over your children?

    Tim

Apply for your data protection files it costs £10 now .It should take 40 days but sometimes takes longer .If you know roughly the dates you spoke to them the dp files will show this up as each conversation is supposed to be logged .

Mines showed a load of lies on my account and they are suffering for it now as they had acted illegaly .I have just finished another rant of a letter to the central appeals unit .There are quite a few good CSA officers if they are on your side but some complet (o)holes also .

OK thanks, i'll send off for a copy. I just don't understand why they won't re-assess me when they know it wrong.

So, I don't need to go to court this week?

    Karatedragon .
You can't take the CSA to court as they are Crown Imune .You have to take it on the chin or go through the complaints appeals tribunals MP's etc .
Judges aren't allowed to question them for their resonings .

i.e I think i will freeze x's bank account so they send an order to all major banks via Sherriff Officers (who get paid for this ) and the stupid idiots didn't come back with any of the correct banks i deal with even though they did get there standing order every month from the one i bank with .
  • Hi Tim - like CSA_Help suggested, get your data protection files! That will show up any phone calls or correspondence that you had with the CSA.

Hope that will help. Well done for supporting your child for the past 11 years. It would seem that the CSA are not exempt from making errors both for the NRP and the PWC.
  • Oh, I also would say you should definately go to court! What does a days pay cost you, compared to a potentially incorrect CSA arrear figure?

    I would if i was you .

It gives you a chance to explain to the judge and he may not grant the liability order until they produce productions .

Mines was obvious it was wrong that is why the judge sent them packing 3 times

I keep all records of phone calls and letters etc. All apart from the first phone call where I only wrote the day and the name of the person I spoke to, no date or time. That person I had spoke to has now left the CSA.

Im hoping I called them from my home phone and I've asked bt to send me phone records so I can check.

There is a sticky on the top of this forum re data protection files .

Good luck .The judge will be fine with you as he's probably seen it all before with CSA cases .

    Thanks all for help.

Reading the CSA website it sounds like the whole process of dealing with maintenance should be simple and straight forward.

What happens if the non-resident parent who has struck a deal with the CSA then becomes out of work and on Jobseekers and their income is then less than before?
