I thought the charges were illegal, was told they were just unlawful.
Went along with that happily. Apparently the charges are not unlawful, just the size of the charges
So why aren't people just claiming the excessive charge back, not including an acceptable charge

Quite simply because the banks are not providing any information on the actual cost to them of transgressions. And of course they are grudgingly paying the full amount to anyone proceeding with a claim through the courts.0

Can I complain about M&S please?
They buy knickers in at 50p each and then sell them to me at £4.99.
It is clearly unfair that a big company should be making a profit from my business. Please advise me on how I can reclaim this money.Warning ..... I'm a peri-menopausal axe-wielding maniac

To be honest, it isn't worth the banks challenging it. The number of customers involved is very, very, very small, as a percentage of customer base. A number of them are not really a profit making group:eek: so glad to be rid of.
If it takes off into large numbers, might not be a bad thing, there will be a test case. I suspect the banks will lose;)
