Rent deposit - should this have been protected?

Hi

We're coming to the end of a tenancy agreement and are unclear as to whether our deposit should have been in a protected scheme.

We initially started renting this property in March 2006 but our landlord changed in 2009 (the new landlord inherited the property). We were never given a new tenancy agreement and just transferred our standing order to pay the new landlord instead. We also never received any notification that our deposit was being put into a protected scheme.

I know that the deposit taken with any new tenancy agreement (starting after April 2007) should be put into a protected scheme but I can't find any clear guidance for our situation.

Has anybody come across this before? Does anyone know where we stand legally and whether our deposit should have been protected?

    You might want to ask the new LL who actually is holding the deposit. Hopefully, the deposit details or the deposit itself were passed on to the new LL.

    It doesn't sound to me like you have started a new fixed term so there is no requirement to lodge your deposit. Having said that I would want to ask the new landlord where the deposit is held.

    Thanks for the advice - we'll definitely be contacting our landlady this week to find out where our deposit is!
