Follow up

A big thank you to start with for all the advice that people gave me during my saga with my LA regarding my section 21 notice.

The LL rescinded on the S21 and said that we could have a new 6 month tenancy and the rent being increased which i was very happy with.

I got a letter yesterday from the LA saying that the LL was happy with us to continue being here under the old terms and conditions. No mention of the new 6 month tenancy or rent increase.

I only have email contact from both the LA and LL regarding this nothing in writing on paper. Now my question is, does the rent increase stand and also the 6 month tenancy if i have had nothing new through the post or do i just assume that the tenancy is still on a month to month basis?

    Sounds like you're periodic now. If you've not signed a new tenancy then you almost certainly are.
  • We were on a periodic before all of this s21 happened but the LL said that he would rescind and give us a new 6 month tenancy. No paperwork has been sent regarding this though.

    Have you received a properly served (written) S21? Sounds like yes.
    Have you had anything in writing rescinding it? Sounds like no.

    Have you had a new 6 month contract signed? Sounds like no.
    Have you had written notice of a rent increase? Sounds like no.

    So. You were and still are on a periodic tenancy. Notice has been served so the LL could go to court for possession (though sounds like he won't.)

    Keep paying the original rent and see what happens.
