Adjudicator agrees- bank does not

Hi
I have had a complaint against Lloyds credit card PPI ongoing since 2008 (they got my loan and credit card complaint mixed up so had to start again)
With my loan complaint I was successful and received £700 back. I have just received a letter today saying that although the adjudicator agrees with my complaint, Lloyds have informed him that they do not. He has told me that now it will go to an Ombudsman.
I was wondering if this has happened to others and if so what the outcome was?

Hi, I have seen it a few times and "usually" the Ombudsman will view the same as the Adjudicator unless something else has been provided by either parties to the complaint. If you won already with information you have provided then I would think you will win again regardless.northernfly wrote: »Hi

Hi there
All the best with this and sorry to hear of the messing around due to the mix up.
As Marshallka says, and yes this happens quite a lot, its happened with me and hubby, the final stages its moves on to the ombudman himself, if its not agreed with prior to that and the ombudsman's decision is final, I am with Marshallka you should be okay.

it is very rare an ombudsman overules an adjudicators decision, afterall it would be like me telling my best workmate he'd doen his job wrong, it just does not happen, the ombudsman will follow exactly the same process as the adjudicator has so would come to the same conclusion.
unless further information has come to light, but you would be informaed of that anyway to have an opportunity to comment.
so keep with it, you will win out in the end

It is unusual for a bank to go to an ombudsman after an adjudicator decision. You typically find this only happens on more complicated cases or where the adjudicator is taking an unusual stance. For example, IFAs are more likely to appeal an adjudicators decision as the adjudicator often dont have the knowledge or experience on the more complicated cases that IFAs are more likely to deal with. Whereas an ombudsman would. There was also a case a few years back where a network found out that an adjudicator was automatically siding with the consumer in all cases where they were involved even when they shouldn't have.I was wondering if this has happened to others and if so what the outcome was?
Whilst the majority of cases would see the ombudsman agree with the adjudicator, a significant minority does exist where they overrule.
That said, it is unusual to see a bank appeal a decision on a Loan PPI case. The bank must feel it have something to appeal. They wouldnt do it on a whim. Yes that's right, with mine with LLoyds its coming back to me now, it was agreed with by the first adjudicator, different story with hubby's........although it was not the case of LLoyds not agreeing they ignored the adjudicators decision.The one and only "Dizzy Di"

From the letter I got from FOS- having re read closer it looks like the bank just did not bother to reply in their allocated time period.
It was a really simple claim- the same reasons that I won my loan PPI back- the credit card was taken out at the same time.

Finally heard from FOS and Lloyds Insurance have agreed to pay the PPI that I have paid + 8% interest per annum (some of it is from 2004)
I will hear how much within 8 weeks according to the FOS. Thanks for everyone that helped with this
