How can you sell a property if you are going through a sepration and other owner does not agree to selling it? They also can not get mortgage in there own name either?

Unfortunately you cannot put it up for sale without both owners consent. You can force a sale but it's a long, drawn out and costly way of doing things.
Why doesn't the other party want to sell?My home is usually the House Buying, Renting and Selling Forum where I can be found trying to (sometimes unsucessfully) prove that not all Estate Agents are crooks. With 20 years experience of Sales/Lettings and having bought and sold many of my own properties I've usually got something to say

you will need to apply to court, the process is quick though liaise with the solicitor over charges, as there may be the possibility of getting costs against your partner. i assume no children or they have a disability etc warranting the court to avoid a sale?My posts are just my opinions and are not offered as legal advice - though I consider them darn fine opinions none the less.:cool2:
