Had an offer accepted on a property and all progressing,however my solicitor has just sent me a letter asking for £250 for searches etc as the vendors are not supplying a HIP.
Should I pay this £250 or expect the vendors to pay it as surely its their responsibility to provide the HIP

Does it fall within one of the exemptions?
E.G.:
Mixed use property
Property with tenants in and to be sold as such
Derelict property

Have you asked the EA why they havn't provided a HIP? A gentle reminder that they are flouting the regulations and the hint of a telephone call to Trading Standards should do the trick!My home is usually the House Buying, Renting and Selling Forum where I can be found trying to (sometimes unsucessfully) prove that not all Estate Agents are crooks. With 20 years experience of Sales/Lettings and having bought and sold many of my own properties I've usually got something to say

Insist on the HIP.
It really does puzzle me why so many EAs have a problem with producing them.My first reply was witty and intellectual but I lost it so you got this one instead

The media suggest many agents are telling clients not to bother as trading standards do not enforce.
However, as acting buyers lawyer, I would insist and would threaten a report to trading stndrads. That sparks them into action. YOu need an EPC anyway or there is an offence.My posts are just my opinions and are not offered as legal advice - though I consider them darn fine opinions none the less.:cool2:
