SCS Sofa different size to that ordered

Hi all, I could do with some help with the nuances of my rights after buying a sofa from SCS.

We looked the sofa up online and took the measurements with us, liked the sofa and ordered it. The salesman made a point of saying that it was our responsibility to make sure that access to the property was OK, and that the sofa would get into the room OK. It was going into our conservatory so it wasn't a problem.

5 weeks later, and the sofa turns up 8cm wider than expected, and it won't fit properly in the space we wanted to put it. SCS are resisting, in the end have offered (possibly after discussion with his area manager) an exchange to the 2 seater. They say it is clear from the paperwork that it is my responsibility to measure the one in the shop.

Do I have a good stance to get my refund?

  • No, we didn't measure the one in the shop, the website gave us 206cm wide.

    Could we have the exact words.

    So they expect you to carry a tape measure.To buy a sofa.


    I bought a Sofa from Furniture Village, years ago , salesmen kept stressing it would NOT go thru a standard door . He was right, but had planned for a entrance thru a patio door.

    I wish you luck , hopefully someone can explain a legal solution.

    It was explained at the time this was referring to access to the property and it was how I read it at the time.

    As part of our delivery service, we place your new furniture in your chosen room and take away all the packaging, leaving you free to start enjoying your new purchase. However, if the furniture does not fit into your home, we cannot be held responsible for the cost of any alterations needed to provide adequate access, e.g. joinery or window removal.
    To me, both of these entries are about access. My main problem with them is that the actual size of the sofa differs from that stated online.

    Must admit , I agree .

    The sofa will ( is ) in your house. But refuses to fit where you want it to

    Because the sofa is larger than advertised.
    You seem to have a strong case.

    You took measurements from the internet but obviously failed to read the get out on the bottom of the page..

    I think that the wording , is all about access not the sofa dimensions.
    If , as you imply , its to do with the sofa , 8 cms seems to be 'huge' difference.
    The OP bought ( or try to buy ) a 206 but got a 214
    It was advertised as a 206
    Must be worth a fight :D

    I just think that's a coverall disclaimer....

    How can you comply with the above other than by taking the measurements given on their website and using those when checking your room. Sure, allow a bit extra to be on the safe side, but 8 cm seems quite a lot to me. I live in a titchy little house and I'm sure that I'd have been caught out with this too.

    However, doubt you'd get much better than the two seater if you pursued your complaint.

    Could you reject the sofa , and demand a refund because the sofa is not what was advertised?
