Faulty Toshiba Taptop

I purchased a Toshiba Satellite L450D laptop on 02.01.10. After 30 days the left hand mouse button failed so i returned the unit to Currys. They advised that as it was over 28 days they would not replace and it would have to be sent for repair.

They advised that their repair turn around time was 6 weeks, so i contacted Toshiba direct and they said theirs was 2 weeks so decided to sent it to them which i did on 02.02.10.

They have now had the laptop in repair for over a month saying they are "waiting for a part" and i have been advised by them today that the estimated time of arrival of the part is 11.03.10 !! This will mean the unit has been in repair for 6 weeks.

Toshiba customer services are very unhelpful and all they do is apologise. When i spoke to them today i asked if i could have the unit back without it being repaired just to be told that would be a charge of £78 !!

I don't know where to turn next - any suggestions???

I'm sure the repair turn around time for Currys is 28 days, normally. Check the terms on the repair docket.

If you want it repaired then there's little you can do than wait for the missing part, if Toshiba are waiting I'd imagine Currys would have the same problem.

I find it hard to believe that it takes 6 weeks for a part to arrive for a brand new model of laptop - they must be producing these units still ???

The unit has now been in repair longer than my son has used it for !!

I could be waiting another 6 weeks?? Do i have any rights under Sale of Goods Act ??

Not against the manufacturer you don't. The only thing to do is get the laptop back unrepaired (although you will have to pay the £78) and then get Currys to sort it without causing a "significant inconvenience", which is what you should have done from the outset. If they can't do this then you have the right to demand a replacement or partial refund.

I've got that model laptop and my 'mouse clicker' is not quite right. I wonder if it's a design fault and maybe they're inundated with laptops for repair. I only got mine in december but to be fair I've only been using it since mid jan and i first noticed at weekend. I haven't done anything about mine yet because it still works it is just a bit more de-pressed at the left hand side of the left hand clicker.
Sorry i can't help as i don't know what else you can do. However, I would have thought the contract is with currys for the first year after purchase (no doubt someone will correct me if I'm wrong).
I'm going to monitor the situation with mine and if it becomes a problem I will take it back to the retailer in the first instance.

Yes i don't think i have much of an option other than to get it returned unrepaired and take it back to Currys.

    Thanks

    Well had a result !!

Went into Currys earlier and explained my plight - i am now the proud owner of a new laptop :j

They even met me half way as the replacement was £20 more expensive.

Big cheer for Currys - I am happy again (and so is my 10yr old son for that matter!!)

That's great news. What's going to happen with your old one?
