Have insurance company unlawfully sold my car??

Hi, i recently posted a thread about HPi checks and how useless they were...
Anyway, does anyone know if insurance companies have a governing body that they have to answer to? (like water comps have OFWAT and phone have OFTEL). Apart from going to a solicitor i can see no other way to complain about the insurance company...because i received a letter from DVLA this morning thanking me for informing them i was no longer the owner of my maserati - i haven't even been paid out by the insurance company yet:eek: , so how comes it has been sold on?? What if i didn't want the payout after all and wanted my car back? :confused:

    Sounds like to me,you've had an accident in it,the insurance company have written it off,asked for the log book,which they've sent to the DVLA,to notify a change of owner.Correct?

    I wouldn't worry so much about the DVLA letter.If it was me,I would be more interested in getting the cash into my bank account.

    Start asking your insurance company as to where your wonga is first.Ring them,e.mail them,snail mail them.

    If non of what I've posted is true,then totally disregard what I've said,and this message will self destruct in 5 seconds......

  • Hi, thanks for the reply - like you say, i am more interested in getting the money into my bank account; they have been fobbing us off since April when my hubby had the accident. I think it is going to come to the end of this week and if nothing turns up in the post (they said they will issue chq on Monday) we have no choice but to go to the police and report it stolen!

    The thing is, i really want to write complaining letters (the claim has more issues than just selling it on before paying out) but apart from writing to HO, who do i contact? Do you think it is worth contacting the media?

  • If you look through your plocy documents it will give you the details of where to complain. It will also give you the details of the Insurance Ombudsman.     As the above poster states - the FOS is the governing body of insurance complaints.

    Do you know what catagory of total loss the vehicle was? If it was A or B it must legally be given to a company with breakers licence and therefore irrespective of timing you would never have been allowed to keep the vehicle. If the vehicle was a different catagory of total loss then it comes down to the policybook on if they give you the option to retain the salvage or not.
