Council Tax Refund For Leaving House Empty?

Hi to everyone,

Quick question. I purchased a house back in October 2009 and live in it alone for two weeks, unfurnished before flying abroad for five weeks to get married. I came back to UK with my wife. I was wondering whether there is any grounds to claim back these five weeks worth of tax from my local council or at least get something rather than nothing.

Have you asked the council? Did you register the house as empty at the time?

Errr yeah, I need to ask them I presume... The problem though is that I stayed there alone for two weeks and then left the country for five

I think the problem is you didn't register the house at the time, but the only people that can advise you correctly are your council. As the offices are closed try their website.

I dont think there will be much you can do. I once claimed exemption from council tax for an empty home, but I think you may find the house has to be unfurnished for the period - thats what I had to do.

If there was a mattress in it then its not unfurnished! And you were sleeping there, so its not unoccupied! You may be eligible to get back the 5 weeks, provided you removed the mattress, literally anything at all in the property invalidates the "unfurnished" part.

We found this out the hard way, after storing some boxes in the living room whilst it was unoccupied.

The councils position on this will almost certainly be, that you must first notify and that they will then assess.
however i did manage to win a case with Oxford city after the event and get an exemption backdated, and a court order overturned.

If you don't apply then the council will not know that you want to claim.
Application form is very simple to fill out.

    hi,

I've just had a rebate on council tax for the property we moved out of in December but didn't get rented till middle of January. I just rang local office, explained what happened and gave them my new address (didn't actually ask for rebate as didn't know was eligable). Only a few days later I got a letter saying I was due a rebate due to empty!!

    HTH.

So a five week holiday is worth claiming an exemption for?
