Missed payment amount has been referred to a debt agency by Barclaycard. Help needed.

I have found myself in such a mess recently. I really wish i could turn back time. My life really is a dark place at the moment.

Im £20,000 in debt with three different creditors. Ive been ignoring them all for about four or so months.

I recently finally decided to face up to my problems though. Once i found out the possibility of something like a DMP, a little bit of hope has been given to me.

Now with two of the creditors, ive called them and let them know what my course of action is (being that i plan to go on a DMP). Phone calls went great. They accepted this and told me they would wait till CCCS came back with the plan that was set.

I haven't called one of the creditors though - Barclaycard (whom, im £9200 in debt with. £700 of that which is in arrears from the missed payments). They have referred this £700 in missed payments to Mercers debt agency. Reason i havent called them is because of the uncertainty of how i should handle this. The debt agency sent a letter asking for immediate full payment by the 8th of March, and notified me that if i wern't to make a full payment by then, they would plan to visit my home for a collection! I recieved this letter a few days ago. I also recieved a letter from Barclaycard, notifying me that my card has been cancelled and that the account was now being dealt with by the debt agency.

I have an appointment with CCCS on Friday. Ill likely be arranging a DMP with them. The other 2 creditors im confident that everything will be ok with. Barclaycard is the uncertain one.

How exactly do i try to handle this issue with Barclaycard? There is no way i could make a full payment of that amount. Who should i contact, to inform them that im taking the step of going to the CCCS? Barclaycard? the debt agency? A part of me is considering contacting Barclaycard to request them to drop the full payment request through the debt agency, and to consider my DMP plan.

Any help here would be appreciated.

first things first, do not worry about debt collection, ONLY court appointed bailiffs can seize assets, anyone who 'visits' from a debt collection agency has the same powers as your paper boy i.e NONE,

you do not have to talk to them
you do not have to let them in
and they have to leave your property when asked (politly of course)

just be prepared that if and this is a BIG if they do turn up (95% of the time it is a empty threat to scare you- and doesnt it work well!) they will try to scare you into letting them in your house, do not be bullied by it, there usual tactics include saying 2you dont want all your neighbores to know your business do you?" if they try this just inform them politly that if they do not leave your property you will call the police - which you can do
    Drop a brand challenge
on a £100 shop you might on average get 70 items save
    10p per product = £7 a week ~ £28 a month
    20p per product = £14 a week ~ £56 a month
30p per product = £21 a week ~ £84 a month (or in other words one weeks shoping at the new price)

    Dear Sirs,

    Account No: XXXXXXXXXXXXXXX

Please be advised that I will only communicate with you in writing. Should it be your intention to arrange a doorstep visit, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

    Yours faithfully

Don't worry too much about Barclaycard - on the back of my statement they actually recommend you to contact CCCCS or payplan if you are having trouble paying them. I phoned them told them about CCCS and they were quite happy for me to make token payments for Mar and April, and CCCS to kick in, in April. Try and stay calm.

    Thanks for the help guys.

Ill call them tomorrow to explain my course of action. Hopefully the call goes well.
  • Hi Kler, sorry to hear of your troubles. I've just started a DMP with CCCS and in their paperwork it does say that Barclays are happy to deal with CCCS ,think they are their bankers, so they might look favourably on you DMP, good luck:)

Mercers will eventually pass it back to Bcard who are likely to accept eventually. They like to play games for a while.

I've been on my dmp with CCCS since Jan 08 and Bcard/Mercers were one of my most annoying creditors. Since May 2008, Bcard have accepted my dmp and have continued to, I guess it's just a question of riding the storm with them for a while.

The CCCS will be a good first step to sorting our your problem - good luck!
  • That's interesting as I have a DMP with Payplan and whereas the majority of my creditors (and I have lots) haved accepted their offer, Barclaycard/Mercers is one of only three who are taking their own sweet time to accept. Is it their policy to keep us all sweating? They sure like making phone calls and sending threatening texts. Will be happy when they're off my back!

Good luck, and things will definitely get better .......
Happy to have a wallet devoid of plastic!
Happy to face up to my debts once and for all!
