Bank of Scotland current account

Hi People,

I previously had a joint account with an ex I no longer speak with, there is a £500 overdraft that needs cleared, I used to just service the debt and pay the minimal interest, since the new change in overdraft charges I really need this account to go away, basically I am willing to pay £500 so the account is at zero but my worry is that the ex notices this and spends the bloody money!

I am going to nip in but will they allow my name to be taken off without her consent? can it be at least frozen or closed? I no longer have contact with her.

    First of all, I would place the account in dispute. Bank of Scotland will place a Marital Dispute indicator on the account which will limit operation (you should still be able to deposit money). Once the overdraft is cleared, you can request the joint party name removed, but may find Bank of Scotland are adamant this requires both signatures. It does not.

    I would put the request in writing to branch, citing the appropriate T&C's:-
    23.2 If you have a joint account you can only operate your account on an either to sign basis. This means we will accept the instructions or signature of any one of you.

    If they refuse to except this, then you simply state that if the account operates on a "both to sign basis" the following condition applies:-
    23.3 If you have a joint account and you tell us that you only want us to accept instructions from all of you (and not from just one of you), all of you must first return your cards and unused cheques (if you have a cheque book) to us. We may then close your account and, if we choose, offer each of you the opportunity to open a new account in your sole name.

    It's also worth noting that you can request the joint party's card and chequebook cancelled.
