yes csa again, say one thing then another

Hi,

I started work few months back , so i off my own back phone the csa,
(they where shocked to) am on the old system..

Am on £920 month take home and my morgage is £440.90 and have plenty more out going costs
I have my son 116 nights a year.

Now they told me last week over the phone i have to pay nothing, after having my payslips and bank statments, as ive been hounding them for a decision..
they have been trying to get hold of PWC but she not got back to them in 2 weeks, only to say am lieing i dont have him that much,,
haha thing is i have a court order to say i have him that much silly girl shes shooting her self in the foot, because if i dont have my son that much and she didnt have him ready for me she breaching a court order.but now goig down that road yet...

anyway one minute the csa say I dont have to pay nothing , today there saying I might have to pay £25 aweek,.

I said "How are you assesing me" because if you take into account my morgage its the old system... if you take into account my nights i have him its the new system. csa said we take into account morgage and nights you have him..

I think there a bit lost here.... Now there saying there looking over my case again and getting back to me tomorrow...

just thinking tho,, in 2000 i was on £210 aweek take home and i paid £31 csa because i live at home with my folks, but now am on £230 aweek NOW with a morgage and i might have to pay £25 aweek eh.

please could someone shed some light on this please its driving me up the wall. and need to know bit of the ins and out for when they phone back tomorrow.

    Would it be an idea to get her to close the old case and start a fresh claim?

    Then you would be on the new rules and things might (possibly) be a bit clearer?

    Have you done a calculation on the CSA site?

    Or might you be better off making a private agreement with the PWC?

    The PWC wont speak to me, since i took her to court because she only wanted me to see my son once a week, my son and my self wanted to see a lot more of each other, the PWC is not a nice person, cafcass got involved in court and inviewed my son, and they seen she is using him as a tool. my son is 11 years old..
    because of this she hasnt spoke to me in 2 years not one word..
    and ive been told the old system is much better,. i Have you done a calculation on the CSA site (new system) and it says £25, but am on the old system,
    i think the csa know on the old system i wont have to pay, so there trying to get me assesed on the new system...

    lol.... alot of NRP's will think you lucky she hasn't spoken in two years, but not the best when you're trying to sort things out!!
    Is it up to them what system they use?
    I've only just put a claim in, so am brand new to all this! I just have trouble fiding out what the NRP's net income is.... lol!

  • hah yer, bit hard sometimes tho when theres a problem with my son and i never find out, even when he when into hospital,...

    and i just need to find out once and of all to sort my finances out and know whats happening.

    Shared care (time when the NRP has care of the QC) is taken into account on the old system as well as the new system.

    are right thanks, so really with me been on a low wage and having my son 116 night where do they get
    £25 week from.. when i was paying £31 on £210 in 2000...

    even know i have court order saying am to have my son half of all hols and twice aweek the csa still say i have to prove it with letters and calender dates,
    because the court order says " mothers name" should make "sons name" available for contact on certain days and half of all hols,
    so the csa in there wisdom say thats not saying you have him, he just needs to be available ,,how mad is that the csa havnt got a clue.

    Start keeping a diary of the times you are having your son overnight - it's not about what the courts say, it's about what actually happens so if you're not having him as often as the court ordered, you'll need to go back to court to sort that out. If you are having all the care that's ordered, it will still benefit you to have a detailed record of which nights he's with you, as this gives the CSA something specific to present to the PWC if she tries to claim you're not. They can say to her "can you prove your son was with you on X dates and not with his dad?" so you are then in a stronger position.

    I know what you mean, PWC knows if i have him alot over night i wont have to pay, thats why she has lied.
    I have him more then the order says,
    i have dates ive had him, ive even got a neighbour that has wrote a letter saying he see my son with me weekends and half of hols.
    but even know the csa cant get hold of the PWC, i have to prove am not lieing.

    yes i do,
    the PWC didnt even want me having that , she objected to it in court..but the judge said i need to have it because i have my son over night. incase something happened.
