Surely the argument is going to be that if the letter was not intended to be formal notice to quit why has the tenant left it until after new tenants were found to say so, and why is she now trying to rescind notice she doesn't think she served? Answer is it was intended to be notice but her circumstances have changed.
The original letter was a polite 'heads up' - early warning of possible notice, but not notice iteself.
The LL found the new tenants, not the OP. Naturally when the OP realised new tenants had already been found, alarm bells rang because notice had not been given.
Not 'now trying to rescind notice', but confirming to LL that notice was not given and hence helpfully warning LL he had compromised himself by finding new tenants prematurely.
Of course the above DOES depend on precise wording, but it's a hypothesis.0 -
The new tenants are irrelevant, they are the landlords problem.
I don't think you understand what I was trying to say: my understanding of county court (if this were to go that far) is that the 'balance of probabilities' comes into play. If you had given the landlord a heads up that you were considering leaving in a few months time, then they wanted to show tenants round the same week, clearly you'd immediately get onto the letting agents and point out that you aren't 100% on your dates yet. When you ring around, enquire about everything in your price range, even those stating "No HB/DSS"
We have that on our adverts, but several of our tenants are HB now, after gaining a little more info on them and getting the references from previous landlords. Our main problem with taking on HB is that when we declare it to our insurer there is an additional premium to pay and the excess is increased, its really not a personal thing.
