Why are you claiming this expense off your own insurance? You originally posted that the third party had accepted liability, and their insurer had agreed to pay for the costs.
(Your own insurer will count this as a claim if you claim off them until it is resolved with the third party)0 -
That's how you make a claim. You don't deal with the other person's insurance co directly. You deal with your insurance co and they deal with the other persons insurance co. No, not really. You will need to contact the third party over all your uninsured losses. (And many don't involve their own insurer when liability isn't disputed)
Write and claim the cost of your seats directly off the the third party as they aren't covered in full by Aviva.0 -

As you have gone through your own insurance company they will fix your car and then reclaim the costs off the TP company.
If you are left with any outstanding expenses (like the baby seats) where your company has not paid out the full replacement cost then you can claim these off the TP company.
They are called uninsured losses and can include things like the seats, any excess you had to pay, any extra expenses you incurred due to not having your car available (taxi, hire car) etc. Basically any costs you reasonably incurred and which your insurance company haven’t reimbursed you for.
Do you have legal cover attached to a policy? If you do I’d give them a ring and run it past them.0 -
All other uninsured costs are being dealt with via our insurance co. E.g cost of courtesy car etc. They are just sorting it and claiming back from his insurer. Have just spoken again to our insurance co. They are still saying they will only pay out £100 max per seat. They will claim it against the other person's insurance but say that they have an agreement with Tesco (who the other chap is insured with) that they only pay out £100 per seat……..
There is no way any cosy little agreement between two insurance companies can limit your right to make a third party claim. What if they had an agreement on the maximum they will pay for paintwork? Or injury?
They are just plain wrong and the TP company should cover the replacement seat given the advice from ROSPA (and no doubt the seat manufacturer)
I think I’d push it but I suppose it depends if you can be arsed for the sake of £500
