Does this sound likely?

Brief summery: sept 2009 csa case opened, requested SE tax returns 07-08 + 08-09, sent 07-08 as next not yet completed. Oct 2009 assesment recieved, PWC sent off for a variation, we had no knowlege of this until paperwork recieved jan 2010. Nov 2009 nrp suggested private agreement of higher figure pwc accepted and says she informed the csa who said they would take the 1st two csa deductions 'just to be sure nrp kept word', when 3rd csa payment taken nrp advised by CSA over the phone to cancel DD. End of Jan 2010 reply to variation request and additional paperwork sent, including now completed 08-09 tax return. Feb 2010 letter stating variation rejected but new deduction to include children in nrp household, child tax credits and 08-09 tax return. Last week letter with payment schedual stating revised figure in effect from opening date of case (sept 2009) this now includes arrears because the previously lower figure and collection starts Mar 2010.

Yesterday NRP recieved nastily worded text from PWC basically saying the csa are telling her that they have sent many letters to nrp and he hasn't replyed or returned numerous calls and that he's just being silly and that it he doesn't pay up in march then they are taking him to court, will put a charge on the house and maybe send him to jail for 6 weeks.

1/ the only letters recieved are the ones detailed above
2/ we are not aware of any phone calls (except a possible last week when someone asked to speak to him, refused to leave a message, name or company and said they'd phone back later, but didn't)

Is it likely that they would lie the PWC? Is it best to phone them and try to sort this out or is it better just to ignore it and make the payments starting Mar as they have requested?

We are going to try and get them to take into account the several hundred paid by private agreement but realize that its unlikely that the pwc will admit to having recieved it and therefore its lost.

    I would be checking, at this point, what address the CSA have on file for the NRP (your partner?)

    I would also compile a list of dates/amounts of payments made to PWC. Hope that there is a paper trail here - ie that they have been paid by direct debit into her account or by cheque in which case you have the dates, cheque numbers and amounts.

    Don't know why you don't just pay via the csa and forget this private arrangement thing, some people can't be trusted on both sides.

    Yes I'm NRPP, and they must have the correct address as they have sent the collect schedual etc here.

    We do have details of the 10 weeks of private arrangement as they were paid by DD into her account but as I understand from here if she denies they were in regard of child support then they be ignored. We will try to get theses taken off the arrears because he had an op on dec 1st and cosultant refuses to let him go back to work till at least end of Apr but DwP says he doesn't qualify for ESA so obviously the CSA aren't going to make any allowance either, so all payments will be made by me, thank god I've managed to get a new contract starting tomorrow.

    So we realize now:( Originally suggested private agreement because the figures from the CSA were based on old tax return and didn't give a realistic CS payment (£10/week doesn't seem fair) and she seemed to be behaving reasonably. At this point we didn't know that she'd put in for a variation and having seen the cr*p she wrote in that I will never let OH trust her again (as mother of his children he has a tendancy to 'forget' all the evil things shes done).

    From now on all payments will be made through the CSA although after all I've read here I'm reluctant to set up a DD.

    I would be reluctant to DD too, I pay via SO, pay weekly and the problems can lay with the Agency and PWC, all payment records and scedules I keep filed together just in case the agency want to dream a lie :j

    I paid So for years but when you get a breakdown the figures aren't consistent as some of the money is allocated to the SOS and some to the PWC .Some of it goes into a futures account .

    The big abacus they use can't handle it and could be a couple of hundered pounds out .

    So far it has matched other than when my arrears were completed, the payments started bouncing back into my account for 3 weeks, but settled itself , as I just kept paying the amount in :A

    doesn't mean they haven't got more than one address...
    I spent weeks and weeks trying to tell them correct address for my ex
    (who pays me by SO by private arrangement BUT I e -mail the CSA regularly (well fairly regularly) to confirm payments received.
    So I would double check.

    having said that the threats of court/jail sound a bit OTT - more like the ramblings of a hysterical ex...

    Ah, I hadn't considered that they could have more than one address on file. He's decided he is going to phone them tomorrow so I'll get him to check what address/es they have on file for him. Maybe they'll be able to confirm if they have been trying to contact him! I will also get him to explain that I will be making the payments for the time being but that I am not prepared to DD perhaps then they will give him the dets needed for a SO.

    I do actually think its just her being her, but after all I've read on here wouldn't put it past the csa although surely if you are complying with the instructions they've given then they wouldn't have a case esp considering that the arrears are only about £600 minus the £300 she was paid direct!
  • anything they say on the phone. If you read these and other fora for any length of time you'll learn that they can be 'economical with the truth' in verbal communication.

    Do all contact with them in writing and sent recorded delivery.

    Send for OH data protection file so you see what they actually hold and not what they choose to tell you.
