    Why should you get the car back? It's been stolen from someone, and they deserve to get it back. I hope you get the money back, but not the car.

    Hi Guys,

    Thanks for reading this post. Your help will be much appreciated.

    There is a long story behind this so please sit tight.

    I currently own a business and purchase cars from the public via our website. Customers login and ask for a valuation and if happy with the figure offered we purchase there car. Once purchased these are then placed into auction/other motor traders.

    We have employed a sales manager 2 months ago to run one of our branches. This person has purchased a cloned car, knowing forwell it was cloned. We have since looked at the paper work and found out that our money was transfered to his girlfriends paerents bank account. This was a Mercedes A CLASS on a 57 plate (the true identtity is a 2008 Plate). He has been arrested and the car has been recovered. He is obviously denying this and there is even more evidence which really does put him in BIG TROUBLE (i dont want to disclose this as you never know who is reading).

    As mentioned above the car has been recovered by the police and is due to be returned to the owner or the insurance company (if they have paid out on the car).

    What i need to know is what process i should take to recover my losses. if i can.

    All advice is welcome.

    My advice, and I'm sure you'll probably sneer at this but I'm quite serious, is to consult your solicitor (hire one if you don't have one already) and ask them, by the way, if they think its prudent to discuss this online, anonymous or not. I'm willing to bet they say its a bad idea.

    For someone who is in business buying and selling cars, you don't seem to have much of a clue about the law regarding stolen motor vehicles. Most of the advice posted here has been written about in motoring magazines.
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    This is really not the sort of case for this forum and a solicitor is going to be your only chance.

    But a couple of observations:-

    If he has no money then I think you are stuffed even if you win the case.

    Secondly I would have thought being in the motor trade you would be more clued up than most of us on here on where the car will end up. But it won't be coming back to you unless you buy it from the insurer (IMO).

    Did you not check the car first eg to see if it was legit
