    Sent off the CCA request over a week ago to Barclaycard and have recived this back (it's in 2 parts)

    Overdraft: [STRIKE]£1050[/STRIKE] £980 Capital One: £200 Loan: [STRIKE]£7500[/STRIKE]£1700 (Due to finish in Nov :j) Currently contesting enforceability of Aqua & Barclaycard.

    Ive seen 11 copies of that letter on this thread alone you know! You are not alone..... its a blanket response, i.e. they state they are sending it under separate cover so hold fire and see what comes.

    Until they respond the account is unenforceable ok? No action can be taken, keep us updated with progress.

    Hmmm, so after all that effort they decided to ignore you did they? When you sent my reply (here:#2187) did you send it recorded and if so has it been signed for/received? If so please confirm the date received and i'll sort you a reply to send them.... cheeky so-and-so's!

    It was signed for on the 22nd of Feb. You gave them 21 days so that would be up tommorow. I was going to leave it a bit longer to see what they came back with but I recieved a bu!!shi! box standard "Last low oppurtunity discount" we pay 65% etc.
    That came friday dated the 9/3/10 I've gone from :mad: to should I pay the £200 & get them to include removal of default :eek: then came back to my senses so I'm currently :mad::mad:

    The cheeky beggars haven't even had the decency to write a response :mad:

    Anyway rant over can you quote some of your law at them for me please:D I say yours as they just don't seem to think it applys to them :mad:

    Hi NID, I hope you are well - Just a quick question please.

    Crappy 1 have sent me a reconstituted cca. Along with this is a letter saying "they have complied with their obligation under s78 and confirmed by judge Waksman in Carey vs HSBC a reconstituted copy is compliant".
    It goes on with a whole load of other spiel which is something that I have seen on this site before but cannot find it anywhere. It has taken them about 4 months to get this far. Is there anything I should be doing as they have had dispute letter along with all the reminder letters etc. Should I send the debtors final response letter or leave it as it is please? It is definitely unenforceable as all they have sent me is a piece of paper with OH name & address & signature & now this recon copy. They have also said this is their final response which is fine by me.

    You know what? I think the easiest thing to do here would be to actually report them now, to the FOS and send a copy of your last letter with your complaint.

    I'm re-reading the last letter and its as severe as I can go without being personal and that won't help matters. I'd also consider sending a letter to the CRA's directly, but initially you need to resolve the matter of balance....

    Ok, second thoughts lets try sending this to the CRA's - Default Removal Letter to CRA's with a copy of your last letter here: http://forums.moneysavingexpert.com/showpost.html?p=29943113&postcount=2187

    See what they do...... if the default is removed then the o/s balance doesn't really matter cos there will be no trace of any account anyway! Trust me, try this route first :D:D
